Drabik asked if action on <br />this application should be delayed until the Commission <br />has a list of deficiencies for the property. <br />Pederson pointed out that the CUP would not change <br />anything with regard to the operation of the business. <br />It is merely a way for the business owner to save tax <br />dollars. <br />O'Connell reported that he has always complied with <br />whatever the City has requested of him. <br />The City Planner stated that he is not implying that <br />Mr. O'Connell did not comply with whatever conditions <br />the City imposed when his business was originally <br />approved. <br />Pedersen suggested that perhaps staff should check to <br />determine that original conditions have been complied <br />with. <br />O'Connell asked about these original conditions, and <br />stated that he cannot remember that any special <br />conditions were imposed on him in order to open his <br />business. <br />Drabik pointed out that the business may have complied <br />with previous Code requirements; however,, the Code has <br />changed, and standards may be higher than they were <br />when the business originally went in. <br />The Planner replied that this is correct, and it is the <br />City's option to enforce the new standards at this <br />time. <br />Pedersen did not feel new standards should be enforced <br />if the operation of the business is not changing. <br />Pedersen stated that he only wanted to be assured that <br />the original requirements were met. <br />Carson asked if the business owner could buy junk <br />vehicles and repair and sell them under the CUP that is <br />being requested. <br />O'Connell replied that this is not what he is <br />requesting. O'Connell reported that his intent is to <br />run his business the way he always has. <br />Page 6 <br />
