Circulation Component <br />Description: The Circulation Component attached hereto as <br />Exhibit C is hereby approved by the City. <br />Requirements: <br />1. The interior circulation plan plus access to and from <br />public rights -of -way shall not create congestion or danger and <br />shall be adequate for the safety of the general public. The plan <br />is subject to review and approval by the City Engineer and <br />developer shall supply the City with such data, plans, or as- builts <br />as may be reasonably required. <br />2. Adequate right -of -way for private or public streets, <br />pedestrianways, utilities, ponding, storm water drainage, or other <br />development features shall be provided as may be requested by the <br />City. <br />3. All PUD development shall be properly related to and <br />coordinated with development plans for adjacent and nearby areas. <br />4. The City reserves the right to regulate and control <br />vehicular and pedestrian circulation on both public and private <br />land within the PUD area. <br />6‘. Although Owner does not contemplate subdivision of the <br />subject area at this time, Owner reserves the right to subdivide <br />for tax or other reasons. No part of the area shall be sold or <br />otherwise transferred from the present ownership except under terms <br />of a Council approved subdivision in accordance with the City's <br />Subdivision Ordinance. <br />2. Any and all subsequent development shall be considered as <br />part of the total PUD and all provisions of this Agreement shall <br />apply following said subdivision and sale of individual lots. The <br />City shall require proof that all subsequent owners are aware of <br />said PUD conditions and provisions and necessitates that such be <br />recorded with the County. <br />4 <br />Page 9 <br />
