Being part of a total PUD, normal lot size, setback, and <br />other requirements may or may not be required; variations from <br />strict code requirements shall be so noted and recorded with <br />property deeds along with all other PUD conditions and requirements <br />with specific reference made to note that non - conforming conditions <br />are not being created by that public approval of detailed <br />development plans constitutes an automatic approval of any <br />variances that may be involved. <br />4. Final plats will not be approved by the City until a <br />development agreement is entered into between the applicant and the <br />City. <br />D. Landscaping <br />Site and parking lot landscaping, as it appears on the Owner's <br />site plan (Exhibit DE, shall be installed and maintained as <br />follows: G/ <br />1. A detailed landscape plan be submitted which specifies <br />the types and sizes of materials to be used and designates existing <br />trees to be maintained on site. <br />2. The detailed landscape plan must include, at minimum, the <br />trees shown on the attached site plan for parking lot and site <br />areas. The plan must also include design of plantings and <br />materials to be installed around the principal building and Phase <br />2 of the structure. <br />3. The landscape plan is submitted for review and approval <br />to the City prior to building permit approval. <br />4. The entire site area shall be completely landscaped <br />within 270 days following the completion and occupancy of the <br />building, as per the approved plan(s). <br />5. Landscaping shall be properly maintained and replaced if <br />damaged or lost by winter kill, drought, or other causes. <br />E. Drainage and Utilities <br />Description: The drainage and utilities as approved by the <br />City Engineer as attached hereto as Exhibit '54 <br />1. Easements for drainage or utilities shall be provided as <br />required by the City. <br />2. Provisions for construction and financing of sanitary <br />sewer, public water, surface water drainage, and other utilities <br />shall be made as required by the City Engineer. <br />5 <br />Page 10 <br />
