MINUTES <br />PLANNING COMMISSION <br />JULY 9, 1992 <br />Postma indicated that FHA will check noise levels prior <br />to making loans. Postma suggested that the neighbors <br />not be worried on the developer's behalf about what is <br />under the berm. The developer will address that <br />situation as part of the development. Postma requested <br />that rather than table action, the matter be passed on <br />to the Council, and the developer will meet with the <br />neighbors prior to the July 22nd Council meeting. <br />Herkenhoff pointed out that the Commission is only a <br />recommending body, but if it approves the development. <br />it will be sending a message to the Council. <br />Keis stated that he would prefer to pass the matter on <br />to the Council conditioned on the developer meeting <br />with the neighbors prior to the Council meeting. Keis <br />felt that the biggest problem raised was the noise and <br />lights coming from St. Jude's, and he did not believe <br />that tabling the matter for a month will address that <br />problem. Keis felt that tabling would only delay the <br />project for a month. <br />Postma stated that he will make sure a meeting with the <br />neighbors takes place prior to the Council meeting. <br />Johnson asked if the project would not proceed until <br />FHA grants approval. <br />Postma indicated that FHA will not provide loans for <br />the homes if noise levels are excessive. <br />Johnson pointed out that by the time FHA is involved <br />the project will be underway. Johnson felt the matter <br />should be tabled, and the St. Jude's noise problem <br />addressed. Silbaugh agreed. <br />Garske pointed out that noise levels will be only one <br />of the evaluations used by FHA. <br />Mr. O'Kane was concerned that the developer handling <br />the project for Heritage Development didn't show up. <br />Garske stated that he would prefer to see the project <br />move forward, and that a good faith effort be made with <br />St. Jude's to address the noise. <br />Pedersen agreed, and stated that he was in favor of a <br />strong recommendation. Pedersen pointed out that if <br />the development meets all the City's requirements, it <br />cannot be denied because St. Jude's is making noise. <br />Herkenhoff recommended that the application for <br />Preliminary and Final Plat for Yorkton Ridge West be <br />Page 13 <br />
