MINUTES <br />CITY COUNCIL <br />MARCH 11, 1992 <br />of property taxes that some of the property owners are <br />paying. The property owner felt that the City would <br />have to accept some liability for the road due to the <br />fact that the City issued building permits for the <br />area. It was pointed out that the former City Engineer <br />was hired privately by Mr. Art Ryan to design the <br />project. <br />Dave Germer, 3172 Ryan Lane, asked if the roads were <br />put in to any sort of standards, and asked if there was <br />any action the City could take against the developer <br />who has reaped the profits from the area. <br />The City Attorney reported that there was a development <br />agreement between the City and Mr. Ryan. The Attorney <br />stated that he would have to look at this agreement and <br />research the past history. However, it is clear that <br />the City never accepted the streets within the Park. <br />The Attorney reported that there is the possibility of <br />claims made by the property owners against Mr. Ryan <br />independent of the City. <br />termer reported that there are a number of property <br />owners within the Park which Mr. Ryan holds paper on. <br />Germer reported that he owns his property clear of Mr. <br />Ryan, and when he purchased the property, the issue of <br />the roads never came up. Germer suggested that when a <br />building permit is obtained for any project, it would <br />be his assumption that an issue like roads would have <br />already been dealt with. Germer stated that he <br />supported the improvement of the roads within the park, <br />and felt a square one approach was in order rather than <br />being faced with the same issue in five years. <br />Hanson pointed out that the buildings within the Park <br />exist, the property owners are taxpayers, and the City <br />has to provide a road for emergency services. Hanson <br />felt that the City must work with the property owners. <br />Hanson felt that if an improvement is made to the <br />streets, the property owners must protect that street <br />with curb cuts to protect shoulders, keeping ditches <br />clear, etc. Hanson pointed out that the soil <br />conditions of the area will not change. The best that <br />can be done is to improve the streets and address the <br />water to protect the roads. Hanson stated that if he <br />bought a building in the Park, he would have assumed it <br />was on a City street since the roads show up on maps. <br />Scalze did not feel the City could accept <br />responsibility for a 5 -year road. <br />The City Engineer pointed out that the patch and <br />Page 9 <br />Page 15 <br />
