City of Little Canada <br />Joel Hanson, Administrator <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />RE: Non - issuance of building permit and variance <br />Dear Mr. Hanson: <br />2354 Greenbrier Circle <br />Little Canada, MN 55117 <br />November 14, 1992 <br />1 <br />I am writing this letter in follow -up to a request for a building permit and subsequent <br />request for a Conditional Use Permit. I do not know exactly why the building <br />inspector advised me to apply for both, but I have complied with his request. This <br />is the 2nd request for the same variance due to a mistake made by the contractor in <br />placing the foundation for the house 1981. <br />The placement was never questioned by anyone, including the building inspector <br />that approved the original construction in 1981. <br />I believe a little history of my frustration over the past four years is in order and will <br />help you to see my point of view: <br />In 1988 the vacant lot located to the south of my location was sold to a Greg Ryan. <br />At that time many problems arose between the way Ryan filled in his lot and <br />created a water trap in my back yard. The city had issued a permit to Ryan for 360 <br />cubic yards of fill. He trucked this fill in and leveled it out. Then he proceeded to add <br />an additional 1200 cubic yards of fill to his lot. I complained to the city many times <br />and they finally tagged Ryan for the excess fill, but never required him to remove <br />any of the fill. In a city council meeting in September of 1988, council - person Bev <br />Scalze made the statement that the city has never set a precedent by ever requiring <br />anyone to remove fill added in excess of a permit. <br />Over the last four years Ryan has continually added fill left over from his plumbing <br />business including burying broken concrete add blacktop material. Despite my <br />complaints to the city, Ryan was never made to remove any of the material because <br />an official never caught him in the act. Finally this past summer one of his employees <br />was tagged b the sheriff for illegal dumping on the lot, but was only required to <br />remove what they had dumped that day.
