The city has a way of setting a very poor record of <br />enforcing their laws to protect the tax payers such as myself who has been in this <br />location for over 11 years. <br />I have spent over $15,000.00 in fees for fill, permits, and repairs caused by the <br />water problem created by Ryan. I hope that the city can see my problem with their <br />somewhat unenforceable rules regarding fill and why I am now so royally steamed <br />by their lack of action on my requests for a building permit. <br />In 1988 when this problem started, I had a survey of my lot done in order to put in a <br />fence. At that time it was verified that the contractor had misplaced the foundation too <br />close to the property line on the southeast corner. At that time, I requested a <br />variance from the city and Steve Grittman that city planner shelved my request and <br />suggested that I try to purchase some property from Ryan. This suggestion turned <br />out to be a real joke and has resulted in more trouble between Ryan and myself that <br />anything else. <br />I have now filed for a building permit in order to expand the living area of our house. <br />I was informed by John Palacio, the building inspector, that he wouldn't/can't issue <br />the permit because the variance was never granted. Now I am being told that the <br />matter will not be handled by the planner and the planning commission until <br />December 10 at the earliest!! If things work out the earliest I can expect my permit is <br />Christmas To this I say bullshit!! I want to get the structure up now before winter <br />sets in. It is not my fault that the planner failed to move on this in 1988 when I first <br />requested it. <br />As you can see by the enclosed plot plan & survey that the area requiring the <br />variance is not the same as the area I wish to expand. These are two separate <br />matters and there is no reason what so ever to hold up the construction as I have <br />been informed by the city! The area involving the variance is less than 100 square <br />feet as compared to the addition which is 624 square feet on the opposite side of <br />the lot. <br />In lieu of the fact that the city planner shelved my original request in 1988, I think that <br />the city should get off the dime and grant my request as soon as possible. I feel that <br />the city should be able to resolve this matter no later than November 26, 1992. <br />Page 17 <br />
