MINUTES PLANNING COMMISSION August 12, 1993 Motion seconded by Carson. Motion carried 7 - 0. CUP FOR Messrs. Dick and Tom Cossack, representing Gordies' OUTDOOR Place, appeared before the Commission requesting VOLLEYBALL approval of a Conditional Use Permit to allow outdoor GORDIES' commercial recreation (volleyball) at a location which serves alcoholic beverages. Mr. Cossack reported that Gordies' has been conducting outdoor volleyball for a number of years, and first filled the property in for the volleyball court in 1978. Since volleyball began at Gordies', the City changed its ordinance and now required a Conditional Use Permit. DeLonais reported that the City has received three letters of complaint about the volleyball activity at Gordies'. Cossack reported that the only complaint they received had to do with the whistle being used for the game, and, as a result, they have stopped using the whistle. Keis asked how many nights Gordies' has volleyball. Cossack replied that volleyball is played two nights per week, Sunday's and Tuesday's, with games beginning about 6 P.M. and ending between 9:30 P.M. and 10:00 P.M. The City Planner reported that when the volleyball court was originally constructed, the Code was different. The Code was changed within the last two years to require a Conditional Use Permit for outdoor recreation on property where liquor is served. Drabik asked if alcohol can be served outside. The Administrative Assistant replied that a liquor license runs with the property address, and alcohol is not limited to inside the building. Cossack pointed out that the complaints the City has received did not come to Gordies'. Gordies' has always tried to be a good neighbor. Keis asked if there were tournaments held at Gordies'. Cossack replied that they do hold a couple of tournaments per year, one during the winter. Keis pointed out that a few of the adjacent apartment Page 3
