This memo shall serve as a
summary of the issues raised as we understand them and those steps
we believe the County can realistically take to respond.
1. Can a municipality execute a one -year cooperation agreement
instead of a three -year agreement?
On June 1, 1994, John Swanson of the area HUD office informed
us that in accordance with CPD Notice 94 -09, issued March 24,
1994, local jurisdictions must commit to the full three -year
cooperation period; they may not choose the length of time
they are willing to participate. The language in the notice
is as follows:
Any county that qualifies as an urban county will be
entitled to receive funds as an urban county for three
consecutive Fiscal Years regardless of changes in its
population or boundary or changes in any communities
contained within the urban county during that period.
However, during the period of qualification, no included
unit of general local government may withdraw from the
urban county unless the urban county does not receive a
grant for any year during such period.
Any currently included local government that elects to be
excluded from an urban county must notify the county and
HUD, in writing, that it elects to be excluded. (The date
by which this election must be made is June 15, 1994.)
Such election to be excluded will be effective for the
Minnesota's First Home Rule County
Ninth on rb,ElM raper with>mOVnum N IOC pal mrc.mx rcntnnt
Page 58
