MINUTES <br />PLANNING COMMISSION <br />MAY 12, 1994 <br />Keenan replied that those lots are owned by Mr. and <br />Mrs. Mason, who have indicated that they do not want to <br />develop these lots. <br />DeLonais pointed out the location of the house at 764 <br />LaBore Road, the property to the west of the Keenan <br />property. The house is located somewhat in the middle <br />of the lot and uses the Lake Street right -of -way for <br />driveway access. It was noted, however, that this <br />property has frontage on LaBore Road. DeLonais stated <br />that at some time Lake Street will be improved with <br />sewer and water extended down the cul -de -sac. <br />Keenan stated that the improvement will be an expensive <br />one. Keenan stated that he would like to put a well in <br />on his property at this time. The alternate is running <br />water down from LaBore Road. Sewer would have to be <br />accessed on Keller Parkway. <br />Garske noted that the City Planner has indicated that <br />the hardship criteria has not been met in this <br />instance. Garske stated that he took issue with that <br />comment, and felt there were special conditions and <br />circumstances that warranted a variance in this <br />instance. Garske pointed out the grade of the area, <br />which would preclude Lake Street being improved from <br />LaBore Road through to Keller Parkway. <br />The City Planner pointed out that Lake Street could be <br />improved from LaBore Road to the end of the cul -de -sac. <br />Garske stated that after viewing the property, he feels <br />there is justification for the variance. <br />Davison stated that it was his feeling that Lake Street <br />should be improved at least to the cul -de -sac before <br />Mr. Keenan is allowed to develop his property. <br />DeLonais pointed out that Keenan could be allowed to <br />build, and the City could stipulate that should any <br />additional building permits be requested, the City <br />would require Lake Street to be improved. DeLonais <br />also suggested that the City could allow Keenan to put <br />in a well, and require his participation in assessments <br />for water main improvement when such improvement <br />occurs. <br />2 <br />Page 4 <br />
