MINUTES <br />City Council <br />May 28, 1986 <br />Paul Borg <br />Property <br />Division <br />(Cont.) <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 86 -5 -214 - .APPROVING THE <br />PAUL BORG PROPERTY DIVISION SUBJECT TO <br />SUBMISSION OF A SURVEY TO THE CITY ENGINEER <br />INDICATING THE LINE RUNNING NORTH AND SOUTH <br />AND PARALLEL TO THE EXISTING HOME IS 30 FEET <br />FROM THE HOME AND DUE TO THE FACT THAT THE <br />CITY DETERMINED IN SOME FASHION THAT JACKSON <br />STREET WAS THE FRONT OF THE EXISTING HOME ON <br />TRACT A <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Scalze, Collova, Nardini, Blesener, Fahey. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 15, Pages 212 and 213. <br />Tina Mr. Louis Tima has requested the division of his property on <br />Property County Road C into two lots. <br />Division <br />Mr. Fahey pointed out that the Planning Commission recommended <br />Agenda approval of the division provided Mr. Tima and Mr. Thomas Judd <br />Item No. 9 dedicate 7 addition feet of road easement to the City along <br />Jackson Street. The Planner recommended approval provided that <br />there is dedication of road easement to provide for a 50 foot <br />right -of -way for Jackson Street. <br />Mr. John Daubney, representing Mr. Tima, appeared before the <br />Council. Daubney reported that if Mr. Tina were required to <br />dedicate 17 feet of road easement to meet the 50 foot <br />requirement, this would bring Jackson Street almost into his <br />home. Mr. Daubney reported that Mr. Tima could live with dedicating <br />an additional 7 feet of easement. Mr. Judd is also willing to do <br />this. <br />Mr. Daubney reported that currently the City is using the Tima <br />property when they plow Jackson Street. Daubney felt that if <br />Jackson Street were improved, this would solve this situation. <br />Daubney also reported that Mr. Tima is not in favor of a cul -de -sac <br />at the end of Australian as suggested by the City Planner. Daubney <br />also did not feel that the neighboring property owners would be <br />in favor of the cul -de -sac. <br />Daubney also pointed out that Australian has only a 40 foot right-Of- <br />way, and felt that Jackson Street only needed 40 feet as well <br />Page -12- <br />Page 32 <br />
