MIMUTES <br />City Council <br />May 28, 1986 <br />Tima Mr. Fahey pointed out that Code requires 50 feet of right -of -way <br />Property for a street. Fahey asked Mr. Daubney's rational for departing <br />Division from this requirement. <br />(cont.) <br />Mr. Blesener pointed out that the Time property would be the only <br />property assessed for Jackson Street as it would be the only <br />property benefited. <br />Mr. Daubney indicated that the City would be the one benefiting <br />from the improvement of Jackson Street between Australian and <br />Bluwood as the City needs this stretch of street for traffic <br />movement, street maintenance and snow removal. Daubney pointed <br />out that the City is currently trespessing on the Tima property. <br />Mrs. Scalze felt that the City could turn around the snowplows <br />without trespessing on the Time property. Scalze felt there was <br />no benefit to the City from the improvement of Jackson Street. <br />Fahey stated that he was willing to go with the 40 foot right -of- <br />way as proposed because it is a unique situation, however, Mr. <br />Tima would have to bear the cost of the assessments. Fahey did <br />not feel that the City benefited from the improvement of Jackson. <br />Mr. Daubney pointed out that the cost to improve Jackson might <br />be in the neighborhood of 520,000. Daubney felt that if Jackson <br />Street were not improved with the City picking up the cost, the <br />City would be depriving Mr. Tima from a property right and the <br />reasonable use of his property. Daubney pointed out that Mr. Time <br />has 3/4 of an acre that would be put back on the tax rolls. <br />Mr. Fahey did not feel it was the responsibility of the City to <br />improve Jackson Street so that Mr. Time could split a lot. Fahey <br />stated that the road would benefit no one else except Mr. Tima. <br />Daubney asked if the City were willing to grant a variance so that <br />Tima could access the property from Australian. Daubney pointed <br />out that there is 3/4 of an acre involved and only one additional <br />home would be accessed by Australian. <br />Fahey suggested that the cul -de -sac option at the end of Australian <br />be considered. Fahey suggested that if the cul -de -sac were <br />approved, then Jackson Street between Australian and Bluwood should <br />be vacated. Fahey also pointed out that the property owners on <br />Australian and Bluwood will not want Jackson Street to be improved <br />as they now have quiet dead -end streets. <br />The Planner pointed out that he has proposed a 110 foot cul -de -sac <br />and Code requires 120 feet. <br />Page -13- <br />Page 33 <br />
