MINUTES <br />PLANNING COMMISSION <br />OCTOBER 13, 1994 <br />Rusch reported that some soil corrections are <br />necessary, and he has an excavator who will make the <br />corrections. <br />The City Plannner reported that the soil correction <br />work would be inspected by the Building Inspector. <br />Mr. Garske recommended approval of the Conditional Use <br />Permit for house relocation to 2539 Ruth Street as <br />requested by Mr. Derek Rusch subject to compliance with <br />the recommendations of the City Planner as contained in <br />his report dated October 11, 1994. <br />Motion seconded by Schletty. <br />Motion carried 5 - 0. <br />PROPERTY Mr. George Rossez reported that he owns a 46 foot <br />DIVISION - wide lot on the west side of his house. Mr. Todd <br />ROSSEZ Rice, the property owner to the west of that lot is <br />selling his home; and before he sells, Mr. Rossez would <br />like to purchase 10 feet of the Rice property and <br />combine it with the 46 foot wide lot to widen the lot <br />out. <br />The City Planner felt that the subdivision was <br />acceptable and that the issues raised in his report <br />have been answered. The Planner noted that the City <br />Engineer has indicated no need for drainage and utility <br />easements as part of this lot line adjustment. <br />DeLonais asked Mr. Rossez how much property he owned to <br />the east of this lot. <br />Mr. Rossez reported that in the early 1970's some <br />surveying errors were discovered in this area which <br />showed property lines overlapping by 20 feet. The <br />property owner to the west got their property changed <br />to Torrens, which then took precedent over the adjacent <br />Abstract property. Rossez reported that, as a result, <br />he lost 20 feet of property. <br />Mr. Davison recommended approval of the property <br />division for 191 Australian Avenue as requested by Mr. <br />George Rossez, subject to compliance with the <br />recommendations of the City Planner as contained in his <br />report dated October 10, 1994. <br />4 <br />
