MINUTES PLANNING COMMISSION OCTOBER 13, 1994 Rusch reported that some soil corrections are necessary, and he has an excavator who will make the corrections. The City Plannner reported that the soil correction work would be inspected by the Building Inspector. Mr. Garske recommended approval of the Conditional Use Permit for house relocation to 2539 Ruth Street as requested by Mr. Derek Rusch subject to compliance with the recommendations of the City Planner as contained in his report dated October 11, 1994. Motion seconded by Schletty. Motion carried 5 - 0. PROPERTY Mr. George Rossez reported that he owns a 46 foot DIVISION - wide lot on the west side of his house. Mr. Todd ROSSEZ Rice, the property owner to the west of that lot is selling his home; and before he sells, Mr. Rossez would like to purchase 10 feet of the Rice property and combine it with the 46 foot wide lot to widen the lot out. The City Planner felt that the subdivision was acceptable and that the issues raised in his report have been answered. The Planner noted that the City Engineer has indicated no need for drainage and utility easements as part of this lot line adjustment. DeLonais asked Mr. Rossez how much property he owned to the east of this lot. Mr. Rossez reported that in the early 1970's some surveying errors were discovered in this area which showed property lines overlapping by 20 feet. The property owner to the west got their property changed to Torrens, which then took precedent over the adjacent Abstract property. Rossez reported that, as a result, he lost 20 feet of property. Mr. Davison recommended approval of the property division for 191 Australian Avenue as requested by Mr. George Rossez, subject to compliance with the recommendations of the City Planner as contained in his report dated October 10, 1994. 4
