To be noted is that the City's existing Shoreland Ordinance does not include specific storm water management standards. SECTION 917.050 SPECIAL PROVISIONS FOR COMMERCIAL, INDUSTRIAL, AND PUBLIC /SEMI-PUBLIC USES This section of the draft Shoreland Ordinance states that commercial, industrial and public /semi - public uss without water - oriented need must be set back double the normal setback or screened from view from the water (per Model Ordinance). Because agricultural, forestry and extractive use regulations are not applicable to Little Canada, regulation of such uses, as included in the Model Ordinance, has been deleted from the attached draft. SECTION 917.060 CONDITIONAL USES This section of the draft ordinance is identical to that presented in the Model Ordinance. The section basically imposes additional evaluation criteria on conditional uses which exist in shoreland areas. SECTION 917.070 VARIANCES Like the City's existing Shoreland Ordinance, the draft ordinance makes reference to variance requests within shoreland areas. It should be recognized that the Model Ordinance makes reference to variance requests for lots which hold private sewage treatment systems. This reference has been deleted from the draft ordinance, as it is not considered applicable to the City. In the case of a variance request involving a private sewage system, an applicant would be required to hook up to the municipal system. SECTION 917.080 SUBDIVISION /PLATTING PROVISIONS The Model Shoreland Ordinance stipulates that communities must adopt its subdivision and platting procedures as presented. Thus, the attached draft ordinance simply reiterates the Model Ordinance text. While the City's existing Shoreland Ordinance includes subdivision/ platting regulations, such provisions lack the detail presented in the model and attached draft ordinance. 4 Page 22
