MINUTES <br />PLANNING COMMISSION <br />NOVEMBER 14, 2013 <br />With regard to indoor auto sales, the City Planner reviewed additional <br />conditions that are being recommended to the CUP requirements for this <br />license. Ile noted that State Law requires that a business holding an <br />indoor auto sales license must have five indoor display spaces. The City <br />Planner pointed out that the enforcement issues are complicated for <br />businesses that hold both an indoor auto sales license and an auto repair <br />license. The additional requirements impose separation requirements <br />relative to the floor space dedicated for each of these uses. <br />Knudsen asked if existing license holders will have to comply with these <br />two requirements. The Planner indicated that an existing license holder <br />will have the choice of complying with the conditions of their existing <br />Conditional Use Permit or complying with the new requirements. <br />With regard to salvage vehicle sales and repairs, the Planner indicated that <br />if this use is eliminated, current license holders would be grandfathered in <br />under the conditions of their approval. The presumption is that these uses <br />would be eliminated over time through attrition. The Planner again noted <br />that it is the salvage vehicle sales and repair licenses that cause a good <br />share of Code enforcement problems for the City. <br />Knudsen noted that if new regulations are put in place, this will not <br />penalize those businesses currently holding these licenses, as long as they <br />are in compliance with the conditions of their approval. The Planner <br />indicated that this is correct. <br />Duray asked about the limitations on the number of licenses. The Planner <br />indicated that he is not proposing a change to any existing license number <br />limitations. Duray asked if anyone has applied for an auto salvage sales or <br />repair license recently. The Clerk indicated that with the moratorium in <br />place, the City would not accept any applications for licenses subject to <br />the moratorium. <br />Dan King appeared before the Commission and indicated that he would <br />like to have a car dealers license and open a business on Centerville Road <br />in the former Stenger Auto Body building. Be noted that it is his <br />understanding that the property would have to be rezoned to accommodate <br />this use. The Planner reported that the property is zoned I -P District and <br />would either have to be rezoned to I -1 or a text amendment processed for <br />I -P which would allow auto sales by CUP. The Planner suggested that the <br />rezoning may be more feasible than opening up the I -P District to auto <br />sales. The Planner informed King that once the moratorium is lifted, he <br />would be able to make application for either a Rezoning or a Text <br />Amendment in order to have his request considered. <br />-4- <br />
