MINUTES <br />CITY COUNCIL <br />MAY 1, 1991 <br />a corner lot which is cost being applied to 100% of lot <br />width and 20% of lot length. <br />The Engineer pointed out that approximately the first <br />300 feet of Desoto south of Allen Avenue currently <br />exists. However, that section of street does not meet <br />City standards for a 7 -ton road, and exists, more or <br />less as a driveway section. Therefore, it was his <br />recommendation as part of the street improvement that <br />this section of roadway be reconstructed. The Engineer <br />reported that the road section was put in about 12 <br />years ago. A typical street has a 20 year life, <br />therefore, when assessing the street improvement the <br />Council will have to decide whether or not there is a <br />credit due for the loss of life of the road being <br />replaced. This issue will be decided at the assessment <br />hearing. <br />Larry Hartman, Allen Avenue resident, did not feel it <br />was fair to expect him to pay for the DeSoto Street <br />improvement. Hartman pointed out that he does not want <br />the improvement and should not have to pay for it. <br />Hartman reported that his home faces Allen Avenue. <br />Hartman also felt the existing piece of DeSoto Street <br />was one of the nicest streets in the City. Hartman <br />felt that the improvement provided his property no <br />benefit whatsoever. Hartman reported that he has <br />resigned himself to accept the development of the Costa <br />property, however, cannot accept that he will have to <br />pay for the public improvements. Hartman stated that <br />without the project the existing stretch of DeSoto <br />would last another 10 to 20 years. <br />The City Engineer reported that if the existing section <br />of DeSoto is not replaced as part of the total project, <br />it will break up and have to be replaced within the <br />next couple of years. At that time the replacement <br />costs would have to be assessed to the adjacent <br />properties, and the cost of improving a small section <br />of roadway would be very high. <br />Hartman pointed out that as part of the final phases of <br />the Costa development, he will be assessed for <br />improvement of Allen Avenue, and did not feel he should <br />have to pay for DeSoto. <br />The City Engineer pointed out that according to City <br />policy, the Hartman property would receive the full <br />assessment along Allen Avenue, plus be assessed for 20 <br />feet of frontage on DeSoto Street. <br />Hartman again stated that the existing section of <br />DeSoto Street does not need to be replaced. Hartman <br />felt the replacement was being pushed through for a <br />project that benefits only the Costa property and <br />Page 5 <br />
