Contractor must give written notice to the City of its <br />intention to exercise its option at least 120 days <br />prior to the expiration date of the original term of <br />this Contract. <br />2. General Description of Services. The Contractor shall <br />supply all labor, materials, and equipment necessary to make <br />a complete collection of garbage and rubbish from all <br />residences in the City of Little Canada at least once in <br />each calendar week during the term of this Contract and <br />convey the recyclables to a market which assures these <br />materials will not be landfilled and the yard waste to a <br />Ramsey County site or Little Canada site as decided by the <br />City. <br />3. Definitions. For purposes of this Contract, the following <br />terms shall have the following meanings: <br />A. Collection Service. Collection service is a private <br />operation engaged in collection and transportation of <br />refuse, yard waste and recyclables. <br />B. Day- Certain Collection. Day- Certain collection is a <br />City- approved plan for weekly collection services by an <br />established day- certain schedule. This schedule <br />requires refuse, yard waste, and recyclable collection <br />on the same day of each week and is based on five (5) <br />day, Monday through Friday, working week. The only <br />exceptions to the "day- certain" plan shall be during <br />those weeks in which occur legal holidays. <br />C. Yard Waste. Yard waste includes grass clippings, <br />brush, and leaves, and specifically excludes limbs, <br />recyclables, and refuse. <br />D. Garbage. Garbage is organic waste, including discarded <br />material resulting from the handling, processing, <br />storage, preparation, serving, and consumption of food. <br />E. Independent Contractor. Independent contractor means <br />person or persons authorized by the Contractor to <br />perform refuse collection services within the City. <br />F. <br />Recvclables. Recyclabies are reusable or <br />reprocessable materials approved and agreed to by <br />the parties hereto. Recyciables may include such <br />items as newsprint, 1 & 2 plastics, magazines, junk <br />mail, corrugated and ledger paper, bi -metal cans, <br />aluminum, and glass. Recyclabies specifically <br />excludes refuse and yard waste. <br />G. Refuse. Refuse is putrescible and nonputrescible <br />2 <br />Page 74 <br />
