ISSUES ANALYSIS <br />Subdivision: It is the intent of the applicant to replat the subject property in a manner which <br />will allow individual ownership of each structure (office condominium) upon the property. In <br />this regard, each structure is to overlay an individual lot of record. The balance of the property <br />is to be designated as common space and should be established as an individual lot. <br />Phasing: According to the applicant, the development is to be constructed in two phases with <br />the four westernmost buildings being constructed in the first phase. <br />Property Owners Association: According to the Zoning Ordinance, common open space <br />provided as part of a PUD may be placed under the ownership of a property association <br />provided a specific set of conditions are met. As a condition of PUD approval, a declaration <br />of covenants should be submitted and subject to review and approval by the City. <br />Easements: <br />NSP Easement. As shown on the submitted site plan, a 225 foot wide NSP easement <br />overlays the southern two - thirds of the subject property. While the office buildings <br />themselves lie outside of such easement, four individual garage structures have been <br />proposed to lie within the easement's borders. According to Ms. Judy Slavik of NSP, <br />the erection of structures within such easement is strictly prohibited. As such, the <br />illustrated garages should be either relocated or removed from the plan. <br />Easement Vacation. Currently, a 20 foot wide drainage and utility easement subdivides <br />the subject building site into eastern and western halves. To accommodate development, <br />the vacation or partial vacation of such easement may be necessary. The need for such <br />vacation should be subject to comment by the City Engineer. <br />Off - Street Parking: <br />Parking Supply. As shown on the submitted site plan, a total of 132 off - street parking <br />stalls are proposed upon the site. This exceeds the City's requirement of 126 spaces as <br />calculated below: <br />Required <br />Use Ratio Spaces <br />Office (25,200 SF) 3 plus 1 for each 200 SF 126 <br />of floor area <br />Dimensions. According to the Zoning Ordinance, off - street parking spaces must <br />measure not less than 8.5 feet in width and 20 feet in length.
