week. Use of compensatory time shall in all cases be subject to the needs <br />of municipal service and prior approval of the employee's Department <br />Head. Each Department Head shall be responsible for providing the City <br />Clerk with an accurate accounting of all such hours worked by an <br />employee. This section is subject to this exception. An employee who <br />works in different job functions within the municipal service in both a <br />full time and part time capacity shall not be entitled to any overtime for <br />work performed as a part time employee until such employee's total hours <br />worked (both full and part time) in a work week exceed forty -eight (48) <br />hours. Thereafter, such employee shall be entitled to pay at the rate of <br />time and one -half for all hours worked as a part timer, which cause <br />his /her total hours to exceed forty -eight (48) hours, with payment for <br />such overtime hours to be based on his /her rate of pay as a part time <br />employee. <br />(E) Use of compensatory time by Department Heads shall be subject <br />to the prior approval of their respective Council liason- person. An <br />accurate accounting of all such hours accrued and used shall be given by <br />each Department Head to the City Clerk for filing. <br />(F) It shall be the duty of the City Clerk to obtain from <br />Department Heads and to maintain on file accurate records for all <br />employees, showing the amount of compensatory time accrued and used by <br />each City employee. <br />(G) For exempt employees, compensatory time shall accrue and be <br />used on a calendar year basis. Any compensatory time not used by an <br />exempt employee during a calendar year shall be forfeited. <br />(H) For non - exempt employees, compensatory time may be banked to a <br />maximum hours of forty (40) hours. All of the compensatory time shall be <br />paid in cash. <br />209.100. LEGAL HOLIDAYS. <br />(A) The following holidays will be observed by full time <br />employees: <br />(1) New Year's Day; <br />(2) Martin Luther King's Birthday, <br />the third Monday in January; <br />(3) President's Day, the third <br />Monday in February; <br />(4) Memorial Day, the last Monday <br />in May; <br />(5) Independence Day, July 4th; <br />(6) Labor Day, the first Monday <br />in September; <br />(7) Veterans' Day, November llth; <br />(8) Thanksgiving Day, the fourth <br />Thursday in November; <br />(9) Day after Thanksgiving Day; and <br />(10) Christmas Day, December 25th. <br />Page 26 <br />PAGE 62 <br />
