Sick leave pay shall be computed at the regular rate of pay to which such <br />employee is entitled. Sick leave shall not be granted to temporary <br />employees. <br />(B) Sick leave may be accumulated to a maximum of one hundred <br />twenty (120) days. <br />(C) Sick leave may be granted only for absence from duty due to an <br />illness or injury of the employee which disables him /her from working. <br />However, up to three (3) days sick leave may be granted in case of death <br />in the immediate family, i.e., spouse, parents, spouse's parents, <br />children, brothers, and sisters, brothers -in -law, and sisters -in -law, and <br />grandparents. Employees may use two (2) days of their annual sick leave <br />in hourly increments for doctor or dentist appointments for their own <br />medical and dental health care. <br />(D) Employees who are absent from work and are being paid worker's <br />compensation insurance benefits shall be considered to be working for the <br />purpose of accumulating additional vacation leave or sick leave for up to <br />three (3) months of absence from work. No sick leave or vacation benefits <br />will be earned while receiving compensation payments for time exceeding <br />three (3) months. <br />must: <br />(E) In order to be eligible for sick leave with pay, an employee <br />1. Report promptly to such employee's Department Head the reason <br />for the absence. <br />2. Keep such employee's Department Head informed of such <br />employee's condition, if the absence is more than three (3) <br />days duration. <br />3. Submit a medical certificate for any absence exceeding three <br />(3) days if required by the Department Head. <br />(F) The misuse of sick leave, such as claiming sick leave when <br />physically fit, shall be grounds for immediate dismissal. <br />(G) Sick leave shall not be granted for less than one -half day. <br />(H) Sick leave credit shall not accrue to any employee during any <br />period of suspension, layoff, leave of absence or other off payroll <br />status. <br />(I) In lieu of sick leave pay, for any absence not exceeding two <br />(2) days, an employee may elect to take leave without pay or use <br />compensatory time. <br />209.130. LEAVES OF ABSENCE AND EMERGENCY LEAVE. <br />(A) After receiving a recommendation of the Department Head, the <br />City Council may approve a leave of absence of an employee without pay for <br />a period which shall not exceed ninety (90) calendar days. <br />Page 29 <br />PAGE 65 <br />
