MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2014 <br />OUTDOOR The City Planner noted that the City Council recently adopted changes <br />RETAIL to the Zoning Code relative to indoor vehicle retail sales licensing, and <br />VEHICLE based on that action may want to consider addressing outdoor retail <br />SALES vehicle sales licensing. The Planner noted that the City currently has a <br />LICENSING license maximum of four for outdoor retail vehicle sales. There are <br />currently three active licenses and the fourth was not renewed. The <br />Planner suggested that if the Council wants to consider decreasing that <br />license maximum to three, this would be the time to do so as it would not <br />impact existing license holders. The Planner also noted that there is a <br />housekeeping matter in the Code that should also be addressed. There are <br />some Code references to outdoor retail vehicle sales in the B -3 District, <br />although this is not an allowed use in the District. Therefore, the Planner <br />recommended that these references be eliminated. The Planner suggested <br />that if the Council is agreeable to considering the maximum number of <br />outdoor vehicle sales licenses as well as addressing the housekeeping <br />issue, a public hearing should be called for the Council's February 26th <br />meeting. <br />Blesener asked if outdoor retail vehicle sales has been a code enforcement <br />issue for the City. The Administrator indicated that there have been code <br />enforcement issues, especially when this license is combined with Salvage <br />Auto Repair and Sales Licenses. The Administrator noted, however, that <br />the recent Council action eliminated the Salvage Auto Licenses. The <br />Administrator stated that the City has not had issues with current Outdoor <br />Retail Vehicle Sales License holders. He noted, however, that whether the <br />City has code enforcement issues with license holders is dependent on the <br />operators. He also noted that the City has had a maximum on this license <br />for many years, and decreasing the maximum will not impact current <br />license holders. <br />Blesener suggested that there may be property owners opposed to the <br />decrease. The Administrator suggested that although a zoning action of <br />this nature would not require a mailed public hearing notice, staff would <br />mail a notice and letter to impacted property owners. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014 -1 -17 — CALLING A PUBLIC HEARING <br />FOR WEDNESDAY, FEBRUARY 26, 2014 AT 7:30 P.M.
