MINUTES <br />CITY COUNCIL <br />JANUARY 22, 2014 <br />RELATIVE TO THIS LICENSE AS RECOMMENDED BY THE CITY <br />PLANNER <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nayes (0). Resolution declared adopted. <br />CITY The City Administrator reported that the firm of Kelly & Lemmons has <br />ATTORNEY served as the City Attorney for 2008. He noted that when this change was <br />CONTRACT made, the City achieved a substantial reduction in its legal costs. The <br />Engagement Letter with Kelly & Lemmons has expired, and the City <br />Attorney's office has submitted a new Letter. The firm has not proposed <br />an increase in civil costs, but has requested the retainer for criminal <br />prosecution be increased from $5,000 per month plus expenses to $6,133 <br />per month plus expenses. The Administrator reported that he reviews the <br />City Attorney's monthly invoices, and criminal prosecution costs have <br />exceeded the $5,000 retainer on a monthly basis. He also noted that <br />changing court assignments have resulted in the City Attorney spending <br />more time on Little Canada's behalf. The Administrator also indicated <br />that given the City's 2014 Budget was based on current costs, the City <br />Attorney's office has agreed to implement half of the increase in 2014 <br />with the full increase effective 1/1/2015. <br />Boss asked how long the updated Engagement Letter is good for. The <br />Administrator replied five years. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014 -1 -18 — APPROVING THE KELLY & <br />LEMMONS ENGAGEMENT LETTER AS SUBMITTED AND <br />AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO <br />EXECUTE ON BEHALF OF THE CITY <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />FIRE The City Administrator reported that the Little Canada Fire Relief <br />RELIEF Association, through the Little Canada Fire Department, is requesting a <br />BENEFIT benefit increase of $65 per year of service, resulting in a $3,265 benefit <br />INCREASE per year of service at full vesting. The last increase in this benefit level <br />was approved on May 22, 2013. The Administrator noted that there is a <br />lot of analysis that goes into reviewing potential benefit increases.
