MINUTES <br />CITY COUNCIL <br />MARCH 12, 2014 <br />LITTLE <br />CANADA <br />ROAD <br />SHOPPING <br />CENTERS - <br />DEVELOPMENT <br />AGREEMENT <br />The City Administrator recommended to the Council that the City increase <br />its offer for the easement and damages by $3,600 to $16,400, and that the <br />City pay for their appraisal cost of $1,500. The Administrator indicated <br />that under the Uniform Act the City would be obligated to pay the <br />appraisal cost. The increase in easement compensation avoids further <br />costs associated with an acquisition. Those costs would be substantially <br />more if a contested process were necessary. The Administrator also noted <br />that the increased cost somewhat offsets cost the Church incurred to install <br />a new sidewalk to the Parish Office done in conjunction with the public <br />improvements. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014 -3 -50 — APPROVING ACQUISITION OF <br />EASEMENTS FROM ST. JOHN'S CHURCH RELATIVE TO THE <br />LITTLE CANADA ROAD IMPROVEMENT UNDER THE <br />PARAMETERS AS OUTLINED IN THE CITY ADMINISTRATOR'S <br />REPORT DATED MARCH 7, 2014 <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Administrator noted that at its last meeting, the City Council <br />did an architectural review of exterior improvements proposed for the <br />two shopping center buildings on Little Canada Road. That approval <br />was contingent upon a development agreement with the property owner <br />to ensure compliance with deadlines for landscaping improvements. At <br />that meeting, the Council had reviewed a concept landscape plan which <br />included slope stabilization along the public sidewalk, improvements to <br />the sidewalk, as well as landscaping elements within the shopping center <br />property. Mr. Bongine, owner of the shopping center, has asked for a two <br />year timeframe to complete the landscape plan. <br />The Administrator noted that the City would have to do the sidewalk <br />repairs regardless of the proposed improvements to the shopping center, <br />and indicated he proposed to Bongine that the City participate in the <br />sidewalk improvement. He also suggested to Bongine that the City assess <br />his property for the shopping center's share of the sidewalk costs. This <br />would free up dollars that the property owner can direct to other <br />improvements noted in the landscape plan. Bongine has indicated that he <br />will determine the landscaping costs and think about this proposal and get <br />back to the City. <br />5 <br />
