MINUTES <br />CITY COUNCIL <br />APRIL 9, 2007 <br />MONTREUX The CEO reported that Henry Anderson has removed the living space <br />PROPERTY from the garage on the Trobec/Montreux property. He has also been <br />working to correct fire code violations and clean up outdoor storage. <br />DUPLEXING The City Administrator reported that the City has been receiving some <br />complaints about illegal duplexing of City properties. The Administrator <br />reviewed the City's Code definitions and provisions that would apply to <br />dwelling units and boarders. He indicated that staff would continue <br />enforcement under the current Code. The Administrator noted that in <br />looking at the Codes of adjacent cities, Little Canada's appears to be <br />stronger. <br />ORGANIZED The City Administrator reported that the first organized collection <br />COLLECTION billing by the City will occur with April 15`~ utility bills. He also reported <br />on the number of exemptions from service that have been approved. <br />McDONALDS/ The City Administrator reporCed that progress has been stalled on the <br />OASIS/ acquisition of the Oasis property given that their mortgage company is <br />VIKING reluctant to release the property from the mortgage. The Administrator <br />DRIVE indicated the options that exist: close on the property with purchase <br />UPDATE funds placed into escrow so that Oasis can resolve the issues with their <br />mortgage company, or acquire the property through eminent domain. The <br />City Administrator indicated that he would be discussing the eminent <br />domain option with the City Attorney. Eminent domain would add cost <br />to the process as well as take approximately four months. There is also <br />the issue that we are technically not acquiring road right-of--way from <br />Oasis, but rather transferring the property to McDonalds for road right-of= <br />way. The new eminent domain law precludes acquisition of property for <br />transfer to another private party. The Administrator also reported that he <br />has asked for a conference call with Oasis, their attorneys, and the <br />mortgage company to resolve the matter. <br />The City Administrator pointed out that the City is scheduled to close on <br />91 Viking Drive. He indicated that he thinks the Oasis acquisition will <br />work out, and pointed out that the City has the option to acquire through <br />eminent domain. Keis asked if the Oasis purchase does not go tluough, if <br />the City would be able to recover its money through the sale of 87 and 91 <br />Viking Drive. The City Administrator replied that the City could combine <br />these sites and sell the property; however, it would not recover its full <br />cost. The Administrator felt that the biggest risk was to the McDonalds <br />redevelopment. <br />4 <br />
