2) The applicant shall demonstrate by clear and convincing evidence that the <br />proposed site is or will be compatible with present and future land uses of the <br />area. <br />3) The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use conforms with all performance standards contained herein. <br />4) The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use will not tend to or actually depreciate the aggregate property <br />values in the area in which the amendment or conditional use is proposed. <br />5) The applicant shall demonstrate by clear and convincing evidence that the <br />proposed use can be accommodated with existing public services and will not <br />overburden the City's capacity. <br />6) The applicant shall demonstrate by clear and convincing evidence that the <br />development of the conditional use shall reflect the architectural character of the <br />buildings in the surrounding area in regard to the following: <br />a. Proportion, scale and roof line, <br />b. Architectural style; and <br />c. Exterior finish materials. <br />Use of City -owned Property. According to the Ordinance, commercial antennas and <br />towers must connect to and use the City tower sites if determined technically feasible. <br />In this regard, the proposed location of the tower on a City -owned parcel of land fulfills <br />this requirement. <br />Land Use Compatibility. The subject site is zoned 1 -1, Light Industrial and is <br />surrounded by industrial uses. There does not appear to be any conflict with adjacent <br />residential properties or high volume roadways. <br />Setbacks. According to Zoning Ordinance, all new towers must comply with one of <br />following setback calculations options as measured from the base of the tower to the <br />nearest property line: <br />Equal to the height of the tower, including any antenna attachments, plus five (5) <br />feet from any residential use, exclusive of the property in question, any <br />residential, business, or public zoning district or any church or school. <br />2. Equal to the specific "fall zone" of the proposed tower as determined and certified <br />by a qualified and licensed professional engineer, but in no event less than the <br />Little Canada Zoning Ordinance General Provisions 903 -62 principal structure <br />2 <br />
