MINUTES <br />CITY COUNCIL <br />APRIL 23, 2014 <br />$1,400 in cost depending on whether there is vermiculite in one of the <br />walls. The Administrator also noted that staff is recommending that <br />Retrofit Recycle be awarded the work for disposal of regulated materials <br />as defined in the Legend Environment Services report at a cost of $5,770. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014 -9 -78 — AWARDING THE QUOTE OF ECCO <br />MIDWEST FOR ABATEMENT WORK AT 2858 CENTERVILLE <br />ROAD AND THE QUOTE OF RETROFIT RECYCLING FOR <br />DISPOSAL OF REGULATED MATERIALS AS OUTLINED IN THE <br />CITY ADMINISTRATOR'S REPORT DATED APRIL 18, 2014 <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (3). <br />Nays (0). Resolution declared adopted. <br />TOBACCO The City Administrator noted that City staff conducted a survey of <br />LICENSING surrounding cities relative to tobacco license limits and categories as was <br />directed at the last Council meeting. He noted that none of the other cities <br />have imposed license limits or categories. The Administrator pointed out <br />that these cities have not had to deal with the issue of hookah lounges and <br />sampling as Little Canada had been faced with. The Administrator <br />pointed out that as a result of the sampling issue, Little Canada amended <br />its ordinance to create two categories of tobacco licenses — a general <br />license and a tobacco store license. The City also imposed a limit of ten <br />licenses, which was the number of license holders at the time. The <br />Administrator indicated that given that there will likely be one available <br />tobacco license during the next renewal period, staff has raised the issue of <br />License limits and categories for the Council's consideration. The <br />Administrator pointed out that one of the options put forth was to impose a <br />license limit based on license category. <br />The Administrator felt that there was no need to limit the number of <br />General Sales Tobacco Licenses as the sale of tobacco products is an <br />accessory use. Ile suggested that the Council may want to consider a limit <br />on the number of Tobacco Store Licenses noting that in addition to the <br />sale of tobacco and tobacco - related products, this license would allow the <br />sale of paraphernalia. The Administrator noted the issues that the City of <br />Duluth has had with a head -shop. <br />Keis asked if the City received calls inquiring about the availability of <br />tobacco licenses. The City Clerk replied that it does, noting two in the last <br />month. The Clerk reported that the initial request is typically for a hookah <br />9 <br />
