MINUTES <br />PLANNING COMMISSION <br />JULY 10, 2014 <br />property rather than in the right-of-way as would be typical of street trees. <br />The planting location interferes with Mr. Peter's building plans as the lot <br />currently exists; therefore, the lot line adjustment is being requested. Mr. <br />Peter's would provide an easement to Pitrina Park allowing them to <br />maintain the trees. The Planner noted that the Joe Peters is proposing to <br />develop the vacant parcel at the corner of Centerville Road and Allen <br />Avenue with an industrial building that will essentially mirror his existing <br />building to the north. The Variance is requested since the shift of 10 feet <br />from one lot to the other makes the width of the southern lot non- <br />conforming. The Planner pointed out that this essentially shifts lot width <br />non -conformity from the south lot to the north lot. <br />The Planner indicated that staff is recommending approval of both the <br />Property Division and the Variance. With regard to the Variance, the <br />Planner indicated that unique conditions are present justify its approval. <br />Without approval of the Property Division and Variance, the property <br />owner could build on the current parcel and would remove the existing <br />trees eliminating an effective landscape screen for the adjacent residential <br />property. The Planner also noted that the lot line adjustment reduces the <br />overall non -conforming conditions between the two parcels and retails <br />existing tree plantings which is consistent with the objectives of the <br />Zoning Ordinance. <br />Tom Fischer indicated that while he does not believe it to be a conflict of <br />interest, he wanted to note that he is a resident of the Pitrina Park <br />townhomes. <br />Joe Peters reported that he is the owner of both parcels on Centerville <br />Road. Peters noted that shifting the lot line by nine feet would result in <br />both parcels meeting the Code's 150 foot minimum width. Peters stated <br />that he was not opposed to shifting the lot line nine feet rather than the ten <br />feet proposed. This would negate the need for a Variance. <br />Murphy asked if having one lot width as non -conforming would cause Mr. <br />Peters any problems in the future. The City Planner reported that the lot <br />would be legally non -conforming and would not cause any future <br />concerns. <br />Fischer reported that Mr. Peters met with the Pitrina Park Homeowners <br />Association early this week to explain the proposed Property Division and <br />Variance. The Homeowners Association is supportive of these requests <br />and appreciates Mr. Peters' willingness to preserve the trees. <br />There was no one else from the general public wishing to comment on this <br />matter. <br />- 3 - <br />
