MINUTES <br />PLANNING COMMISSION <br />JULY 10, 2014. <br />Duray recommend approval of the Property Division for relocation of a lot <br />line ten feet and a Variance from lot width requirements for 3000 and <br />3020 Centerville Road, Joe Peters, subject to compliance with the <br />recommendations of the City Planner as outlined in his July 3, 2014 report <br />which also notes the unique circumstances to this property. <br />Motion seconded by Schwalbach. <br />Motion seconded by 6 — 0. <br />PUD PERMIT — The City Planner noted that in June the Commission conducted a concept <br />56 EAST review for a PUD Permit for a three -unit residential development to be <br />LITTLE located at 56 Little Canada Road East proposed by Thomas Homes. The <br />CANADA review was concept in nature given that there were a number of issued <br />ROAD — related to the application and the lack of ability to document setbacks and <br />THOMAS lot coverages. The Planner indicated that in meeting with the applicant <br />HOMES subsequent to the June Commission meeting, the applicant was exploring <br />some alternative ideas. The applicant then turned in a diagram showing a <br />duplex proposal with included two detached garages. In discussing this <br />drawing with the applicant, the Planner indicated that he learned that in <br />addition to the duplex units, the developer was proposing a carriage home <br />unit over each of the two garages. The Planner reported that he informed <br />the developer that this was not allowed in the City Code, but he could ask <br />the City to consider it. <br />The Planner reported that at the end of last week, the developer submitted <br />additional information relative to duplex development as well as a survey <br />of the property which shows the placement of a single-family home on the <br />lot. The Planner indicated that from the survey it appears that the amount <br />of land on this site is not as much as the applicant suggested. As a result, <br />it would be difficult to site a tri-plex or a duplex on the property and still <br />meet setbacks. <br />With regard to the survey which shows a single-family home, the Planner <br />indicated that he informed the applicant that if he wishes to remove the <br />existing single-family home and replace it with a new single-family home, <br />a PUD Permit is not necessary. The only requirement is that the project <br />meet setback requirements. <br />The Planner indicated that if a duplex is being requested, the situation is <br />the same in that the City does not have enough information to act on that <br />request. The Planner then explained the State Statute wherein the City has <br />60 days to act on development applications which the City can unilaterally <br />-4- <br />
