MINUTES <br />PLANNING COMMISSION <br />AUGUST 14, 2014 <br />Duray asked if there have been code violations on this property. The City <br />Clerk reported that the Code Enforcement Officer has been working with <br />the property owner, therefore, she would assume that there have been code <br />violations. <br />Fischer noted that the outdoor storage was clearly intended to be <br />temporary and a 3 -year permit was granted. It is now 4 years, and the <br />outdoor storage still exists and Anderson is asking for additional time. <br />Fischer stated that he was not comfortable with another 3 -year permit and <br />suggested that perhaps a 2 -year permit would allow the property owner <br />some time to either eliminate the outdoor storage or find a new location. <br />Fischer felt a 2 year permit makes a statement that the City intends this <br />storage to be temporary. Duray agreed. He also noted that Poolside is a <br />long-standing business in Little Canada and felt the City should work with <br />this business. Duray asked about the recommendation in the Planner's <br />report that an escrow he established to ensure compliance with PUD <br />Permit conditions. The City Planner was unsure whether that had been <br />done. Anderson indicated that he was agreeable with that <br />recommendation provided the escrow amount was reasonable. <br />Fischer asked about the recommendation that the outdoor storage area be <br />paved. He asked if it was reasonable to not require paving if the outdoor <br />storage is truly to be temporary. Anderson indicated that the area is <br />surfaced with Class V and requiring paving would be a hardship. <br />The City Planner suggested that the Commission discuss the screening and <br />paving recommendations. Duray noted Anderson's earlier comments that <br />landscape screening would not survive along the fence area and asked <br />what other type of screening would be acceptable. The Planner indicated <br />that either landscaping or a solid fence would provide the needed <br />screening. Anderson noted that there is a solid fence along a good portion <br />of Jackson Street, but that the fenced changed to chain link in one small <br />area. Anderson suggested that he could put landscaping on the inside of <br />the chain link fence area. Maleitzke asked what the solid fence did not <br />extend the entire length along Jackson Street. Anderson reported that this <br />was the adjacent property owner's preference so that he could see out <br />through to County Road C. <br />Barraclough asked if not requiring paving of the outdoor storage area <br />would set a precedent. The City Planner noted that given the property is <br />zoned PUD, there would be no precedent. Fischer asked if paving was a <br />requirement of the previous PUD Permit. The Planner indicated that it <br />was his recollection that it was. Duray asked if it would be acceptable to <br />require the Class V surfacing for two years given the storage would be <br />7 <br />12 <br />
