MINUTES <br />PLANNING COMMISSION <br />AUGUST 14, 2014 <br />Miranowski stated that they agreed to the tabling and that a 60 -Day <br />Waiver would be submitted. <br />Maleitzke suggested that another neighborhood meeting be held with the <br />residents of the area to get more feedback. Houwman reported on the <br />neighborhood meeting that was held earlier in the week. He felt that <br />meeting was successful. Fischer noted that the neighborhood meeting was <br />held at 2 p.m. and indicated that some people may not have been able to <br />attend because of the time. <br />Fischer listed the additional information that the City Planner <br />recommended be submitted. This included the following: <br />*Traffic study analyzing peak traffic generation and flow. <br />*Parking study analyzing parking demand and impacts on other <br />retail tenants. <br />*Operational considerations to manage outdoor and noise impacts, <br />especially in the north area of the site. <br />*Screening and buffering improvements that would insulate late- <br />night aspects of the facility from the adjoining residential <br />development. <br />*Upgraded site plan to comply with the City's landscaping and site <br />improvements required in the Architectural Guidelines and <br />Zoning Ordinance. <br />Miranowski indicated that he texted Chris Gnetz, the owner, about tabling <br />this matter, and Gnetz indicated that he did not support the tabling as <br />September would present too much of a delay for the project. <br />Duray recommended denial of the Architectural Review and the PUD <br />Permit for a restaurant -bar -live music venue at 27-47 Little Canada Road, <br />Voodoo Live, based on the following findings of fact: <br />1. The proposed use cannot demonstrate adequate parking on the <br />property, considering other retail uses present, to meet the requirements of <br />the City's zoning regulations. <br />2. The proposed use is likely to create noise and other impacts in the <br />portion of the property that abuts a residential area, and which would be <br />incompatible with the adjoining land uses. <br />3. There are no buffering or screening measures present or proposed <br />which would be able to mitigate the impacts of late night, outdoor activity. <br />- 18 - <br />
