MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />restaurant/bar. There is no new floor area proposed to be added to the <br />building. The Planner noted that the property is zoned Planned Unit <br />Development (PUD) District and lies within the Rice Street/Little Canada <br />Road Architectural Review District, therefore, the proposal is subject to <br />both Architectural Review and a PUD Permit. The Planner noted that <br />there was a significant amount of discussion at the Planning Commission <br />meeting relative to issues of compatibility with the neighboring residential <br />areas, including senior housing directly north, as well as noise conflicts <br />that may occur at the end of live music events. Traffic generation and <br />impacts on other area uses was discussed as well as security procedures <br />and policies, off-street and off-site parking and the available parking <br />supply. The Planner noted that at the Planning Commission meeting <br />representatives of the applicant indicated that some off-site parking would <br />be proposed. This was information that was not part of the original <br />application, therefore, was not addressed in the planning report. The <br />Planner indicated that the Zoning Ordinance allows off-site parking by <br />Conditional Use Permit, however, that parking must be under the same <br />ownership as the principal use being served or under public ownership and <br />shall not be located more than three hundred feet from the main entrance <br />of the principal use being served. <br />The Planner indicated that initially the Planning Commission intended to <br />table action on the Architectural Review and PUD Permit pending receipt <br />of additional information as recommended in the planning report and as <br />follows: <br />*Traffic study analyzing peak traffic generation and flow. <br />*Parking study analyzing parking demand and impacts on other <br />retail tenants. <br />*Operational considerations to manage outdoor and noise impacts, <br />especially in the north area of the site. <br />*Screening and buffering improvements that would insulate late- <br />night aspects of the facility from the adjoining residential <br />development. <br />*Upgraded site plan to comply with the City's landscaping and site <br />improvements required in the Architectural Guidelines and <br />Zoning Ordinance. <br />The Planner noted that representatives of the applicant had accepted the <br />idea of tabling, but before the vote to table was completed, they requested <br />the matter not be tabled and formal action taken. The Planner indicated <br />that based on the information provided, the Planning Commission <br />recommended denial on a 4 to 2 vote subject to the following findings <br />which are related to the lack of information submitted by the applicant: <br />13 <br />
