MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />1. The proposed use cannot demonstrate adequate parking on the <br />property, considering other retail uses present, to meet the requirements of <br />the City's zoning regulations. <br />2. The proposed use is likely to create noise and other impacts in the <br />portion of the property that abuts a residential area, and which would be <br />incompatible with the adjoining land uses. <br />3. There are no buffering or screening measures present or proposed <br />which would be able to mitigate the impacts of late night, outdoor activity. <br />4. The site plan is inconsistent with the Zoning Ordinance and <br />Architectural Guideline documents in the provision of outdoor green space <br />and pedestrian facilities. <br />Blesener noted that the off-site parking noted by representatives of the <br />applicant at the Planning Commission does not appear to meet Zoning <br />Code requirements as this parking is not within 300 feet of the main <br />entrance proposed for Voodoo Live, nor is it under the Voodoo Live <br />ownership or public ownership. <br />Brian Houwman, architect for the project, indicated that the 159 parking <br />stalls that arc available on-site would meet the requirements for the <br />Voodoo Live restaurant/bar use as noted in the planning report. Houwman <br />indicated that the question is the additional parking that would be needed <br />when music event occurs. Houwman noted that there is off-site parking <br />available to meet parking demands, and asked if the City were willing to <br />work with them on this issue. <br />Keis noted that the Building Official has looked at the Voodoo Live space <br />and has calculated a maximum capacity of 562. The City Administrator <br />noted that the planning report talks about 159 parking spaces for the <br />restaurant/bar use and a total of 79 parking spaces would be required to <br />serve the westerly shopping center. The Planner noted in the report that <br />this equates to a total parking supply requirement of 238 for both retail <br />centers which leaves a deficit of 60 spaces given there are a total of 178 <br />parking spaces to serve both shopping center buildings. These figures do <br />not factor in the parking demand for the live music venue. <br />Houwman reported that they were never informed about the Zoning Code <br />provisions relative to off-site parking. Therefore, they contacted area <br />businesses relative to leasing off-site parking. McGraw pointed out that if <br />this off-site parking does not meet Code requirements, it cannot be <br />considered as part of the PUD Permit process. Houwman asked if the <br />Council were willing to continue the discussion or if it will not be possible <br />14 <br />
