MINUTES <br />CITY COUNCIL <br />AUGUST 18, 2014 <br />CONSENT <br />AGENDA <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-8-159 - APPROVING THE CONSENT <br />AGENDA WHICH CONTAINS THE FOLLOWING: <br />*APPROVING THE VOUCHERS; <br />'APPROVING PLANS AND AUTHORIZING BIDDING FOR THE <br />KELLER PARKWAY LIFT STATION AND FORCE MAIN; <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />THRIVE Blesener noted that the Metropolitan Council has adjusted its <br />2040 population projections for Little Canada in its Thrive 2040 document from <br />approximately 14,000 people to about 11,000. Blesener indicated that this <br />estimate is closer to what would be reasonable for Little Canada, a fully <br />developed suburb. <br />ANIMAL The City Attorney presented a proposed ordinance amendment which <br />CONTROL amends the Code to address the keeping of service animals. 1 -le noted that <br />ORDINANCE service animals are defined as any dog that is individually trained to do <br />work or perform tasks for the benefit of an individual with a disability, <br />including physical, sensory, psychiatric, intellectual, or other mental <br />disability. The Attorney indicated that the ADA does not require that <br />service animals be certified or licensed as such, just that the dog is <br />individually trained and works for the benefit of the individual with a <br />disability. <br />The Attorney reported that the City has recently had a situation where an <br />individual was charged with having animals in excess of what is allowed <br />by Code. The citizen argued that some of the dogs were service animals <br />trained to perform tasks related to disabilities for her, her partner, and her <br />partner's daughter. The Attorney indicated that the courts have held that <br />service animals under the ADA cannot be counted for the purpose of local <br />animal control ordinances. <br />The Attorney reported that in reviewing the City's ordinance, it was found <br />that there is no language regarding service animals.
