MINUTES <br />CITY COUNCIL <br />AUGUST 25, 2014 <br />There was additional discussion on the issue of the retaining wall versus <br />using the back of the warming house building for this purpose. The City <br />Engineer explained a cross section of the area, noting that less fill would <br />be needed if the back of the warming house is set into the bank. The issue <br />would then be keeping people off the roof of the warming house which <br />could be accomplished through fencing. The Engineer noted that there <br />would be up to 17 feet of land available from the adjacent Church property <br />that could be purchased by the City without impacting building setbacks <br />on the Church property. <br />Blesener suggested using the back wall of the building to stabilize the <br />slope. The Administrator pointed out that then a greater Variance would <br />be needed. It was noted that there would be additional costs associated <br />with reinforcing the back building wall so it could be set into the bank. <br />Those costs as well as fill and fencing costs need to be evaluated to <br />determine which is the best option. The Engineer pointed out under either <br />option a drainage pipe would be put in to address drainage concerns. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-8-167 — APPROVING A VARIANCE TO <br />THE REQUIRED SETBACK TO PERMIT THE RECONSTRUCTION <br />OF AN EXISTING WARMING HOUSE SHELTER MEETING <br />ACCESSIBILITY REQUIREMENTS AT 430 LITTLE CANADA <br />ROAD BASED ON THE FINDINGS AS OUTLINED IN THE CITY <br />PLANNER'S REPORT DATED AUGUST 8, 2014 AND THE FACT <br />THAT THERE IS AN ERODING STEEP SLOPE BETWEEN THE <br />CITY PROPERTY AND THE CHURCH PROPERTY WHICH CAN BE <br />ADDRESSED WITH THIS PROJECT, THERE ARE LARGE TREES <br />ON THE TOP OF THE SLOPE WHICH WOULD THEN BE <br />RETAINED, AND THE NEED TO MAINTAIN ACCESS TO THE <br />AREA FOR THE ST. PAUL WATER DEPARTMENT, WITH THE <br />FURTHER UNDERSTANDING THAT THE CITY SHOULD PURSUE <br />THE PURCHASE OF ADDITIONAL LAND FROM ST. JOHN'S <br />CHURCH WHICH WOULD RENDER THE NEED FOR THE <br />VARIANCE MOOT <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (2) Montour, Boss. <br />Nays (1) Blesener. Resolution declared adopted. <br />The City Administrator reported that staff will work with the Architect <br />and the City Engineer to determine the most economical option relative to <br />the bank. <br />4 <br />
