MINUTES <br />CITY COUNCIL <br />SEPTEMBER 10, 2014 <br />and input relative to conditions it may want to see associated with the <br />individual restaurant operation. Keis asked if the City had discretion in <br />issuing liquor licenses. The Administrator reported that it did, but noted <br />that if an applicant meets the conditions provided for in the Liquor <br />Ordinance, a denial may be viewed as arbitrary and capricious and the <br />City may have more exposure as the result of a denial of a license request. <br />Montour asked if the Administrator's recommendation was to eliminate <br />this available license and then address license requests on a case-by-case <br />basis. The Administrator stated that it was and again noted that a request <br />to amend the Liquor Ordinance to provide for an additional license would <br />allow the City the ability to negotiate conditions with the applicant. <br />Blesener stated that he would support the elimination of the license if it <br />gave the City more flexibility and control. <br />Boss expressed concern that a business looking to locate in the City would <br />review the Liquor Ordinance and see there were no licenses available. <br />The Administrator reported that typically someone looking for a liquor <br />license will contact City staff asking questions about process and whether <br />or not licenses are available. The Administrator noted that when <br />Porterhouse was initially seeking its liquor license, the City tweaked the <br />ordinance to accommodate their request because it was felt that the <br />addition of this restaurant in the City would be a worthwhile venture. <br />It was the consensus of the Council to discuss this matter in more detail at <br />its next meeting when the full Council was present. <br />CITY The City Administrator reported that two quotes have been obtained for <br />CENTER concrete work at the City Center replacing the front concrete entry area <br />CONCRETE as well as the concrete apron at the back sidewalk to the employees' <br />WORK entrance. The low quote was received from Remackel Outdoor Services <br />in the amount of $16,904 with the Administrator noting that unit pricing <br />was obtained since there will likely he some modifications to the entrance <br />layout or size. The Administrator pointed out that this work was bid <br />previously with the Spooner Park concrete work and only one hid was <br />received in the amount of $25,840. That hid was rejected and did not <br />include any colored concrete border which is a part of the new layout <br />proposed. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-9-172 —AWARDING THE LOW QUOTE <br />FROM REMACKEL OUTDOOR SERVICES IN THE AMOUNT OF <br />$16,904 WITH THE UNDERSTANDING THAT THERE MAYBE <br />8 <br />
