MINUTES <br />CITY COUNCIL <br />AUGUST 8, 2007 <br />FRENCH recommended that Council approval of the CUP be amended to reflect the <br />increase to 1,500 square feet of garage space for Mr. French. <br />The Administrator then presented a proposed Development Agreement <br />which governs the construction of the new detached garage and the <br />conversion of a portion of the existing garage to living area. The <br />Administrator indicated that he has included sufficient options to ensure <br />compliance with the terms of the Development Agreement. The <br />Administrator reported that he has reviewed the terms and conditions with <br />Mr. French who is in agreement with the document subject to the increase <br />to 1,500 total garage space. <br />Blesener noted that Item #15 should be corrected to refer to paragraph 12. <br />III. The Administrator agreed with that change. <br />French reported that he has no problems with the Development Agreement <br />and apologized for the change in garage square footage. French informed <br />the Council that he is having trouble finding a private performance bond, <br />which is one of the options listed in the Agreement to ensure that a portion <br />of the attached garage space will be converted into kitchen area. <br />The City Attorney noted that it is difficult to recover on a surety bond, and <br />recommended that this option be deleted from the Development <br />Agreement. The City Administrator also pointed out that a bond would be <br />very expensive for Mr. French, and suggested there may be some cash <br />equivalencies that would satisfy the terms of the agreement while not <br />costing Mr. French so much money. <br />French reported that it has been suggested to him that a licensing bond <br />may be an option. The City Administrator noted that the bond concept is a <br />problem given the difficulty for the City to collect on a bond, if necessary. <br />It was suggested that Mr. French and the City Administrator work out the <br />details of an appropriate financial guarantee. <br />Mr. McGraw introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2007-8-I92 -AMENDING THE CONDITIONAL <br />USE PERMIT USE PERMIT FOR A SECOND GARAGE ALLOWING <br />TOTAL GARAGE SPACE OF 1,500 SQUARE FEET AS REQUESTED <br />BYROYFRENCH, 2988 EDGERTONSTREET, SUBJECT TO THE <br />FOLLOWING CONDITIONS: <br />BUILDING PERMITS ARE ISSUED FOR BOTH THE NEW <br />GARAGE AND THE REMODEL OFA PORTION OF THE <br />EXISTING GARAGE INTO LIVING SPACE SIMULTANEOUSLY; <br />
