MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 2014 <br />noted that a PUD Agreement was never finalized with Mr. Bordsen given <br />that he did not like the terms of the proposed agreement. <br />The Administrator reported that Pre -Wire may be purchasing the Bordsen <br />property, but they are awaiting the outcome of the current cable TV <br />franchise renewal. The request before the Council is to grant an extension <br />of the temporary permit for the Bordsen property at 2962 Rice Street, with <br />Bordsen and Pre -Wire to submit a long-term plan for the use of this <br />property before the end of the year. It was noted that tonight's action does <br />not include the property at 2968 Rice Street. <br />Boss introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-9-183 — APPROVING AN EXTENSION OF <br />THE TEMPORARY PERMIT FOR THE BORDSEN PROPERTY <br />LOCATED AT 2962 RICE STREET UNTIL THE DECEMBER, 2014 <br />REGULAR COUNCIL MEETING <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />AMENDMENT The City Clerk noted that at the last Council meeting there was discussion <br />TO TOBACCO relative to an inquiry to add 250 square feet of tobacco retail space as part <br />ORDINANCE of an existing restaurant. The area that was being considered would he <br />toward the back of the restaurant and could be accessed via a rear door. <br />The Clerk noted that the scenario appeared closer to a tobacco store than <br />accessory tobacco sales. The City has no Tobacco Store Licenses <br />available, but General Tobacco Sales & Display Licenses are unlimited. <br />Given concerns that the General Tobacco Sales & Display License is not <br />well defined in the Ordinance, City staff asked the City Attorney's office <br />to prepare an ordinance amendment which would define this use as it has <br />historically existed in the City. That historical use would be tobacco sales <br />as an accessory use to a restaurant, gas station, convenience store, drug <br />store, grocery store, etc. <br />The Clerk noted that staff also contacted the owner of Gas N Go asking <br />the amount of space dedicated to tobacco display space as an accessory <br />use to this gas station/convenience store. Gas N Go indicated that they <br />have approximately 21 cubic feet of space allocated for tobacco products <br />as well as a small amount of counter space for cigarette lighters. Gas N <br />Go felt that they has more cubic feet of this type of space than the average <br />gas station/convenience store. <br />3 <br />
