MINUTES CITY COUNCIL SEPTEMBER 24, 2014 The Clerk noted that in addition to some housekeeping items proposed by the City Attorney's office, they are also proposing that the ordinance require that tobacco display space under the General Tobacco Sales & Display license be located in the immediate vicinity of the primary point of sale, there be no entrance door opening directly to the section of the store displaying tobacco products, and there be no separate point of sale for tobacco products. 'The Clerk again noted that the ordinance amendments being proposed clarify how the General "Tobacco Sales & Display License has historically been used in the City. The Clerk also noted that the City Attorney's office has recommended that Tobacco License holders be given 30 days' notice of the Council's intent to amend this ordinance. The Clerk indicated that the matter would then come to the Council for consideration at their November 12°i meeting. The City Attorney noted that the ordinance amendment proposed really just defines how the City and General Sales & Display License holders have utilized this license. Montour asked about the cubic footage allocation for a General Tobacco Sales & Display License. The Clerk again noted that the 21 cubic feet is what exists at Gas N Go and that the owner indicated that this amount appeared to be higher than what similar businesses have. The Clerk suggested that when she sends notice to the General Tobacco Sales & Display license holders of the proposed ordinance amendment, she would ask the amount of cubic feet of display space they each have. Christian Torkelson asked if the cubic foot calculation would include product storage. The City Administrator suggested that storage of a box of tobacco products under the counter, as an example, would not be included in the calculation. Anything as part of the visible display area would be counted. It was the consensus of the Council to proceed with notification of the General Tobacco Sales & Display License holders of Council consideration of the ordinance amendment at its November 12th meeting. CALL FOR The City Attorney recommended that a closed session be held to discuss CLOSED pending litigation with St. Paul Regional Water Service (SPRWS) and a SESSION — possible resolution to this litigation.
