MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 2014 <br />The Clerk noted that in addition to some housekeeping items proposed by <br />the City Attorney's office, they are also proposing that the ordinance <br />require that tobacco display space under the General Tobacco Sales & <br />Display license be located in the immediate vicinity of the primary point <br />of sale, there be no entrance door opening directly to the section of the <br />store displaying tobacco products, and there be no separate point of sale <br />for tobacco products. <br />'The Clerk again noted that the ordinance amendments being proposed <br />clarify how the General "Tobacco Sales & Display License has historically <br />been used in the City. The Clerk also noted that the City Attorney's office <br />has recommended that Tobacco License holders be given 30 days' notice <br />of the Council's intent to amend this ordinance. The Clerk indicated that <br />the matter would then come to the Council for consideration at their <br />November 12°i meeting. <br />The City Attorney noted that the ordinance amendment proposed really <br />just defines how the City and General Sales & Display License holders <br />have utilized this license. <br />Montour asked about the cubic footage allocation for a General Tobacco <br />Sales & Display License. The Clerk again noted that the 21 cubic feet is <br />what exists at Gas N Go and that the owner indicated that this amount <br />appeared to be higher than what similar businesses have. The Clerk <br />suggested that when she sends notice to the General Tobacco Sales & <br />Display license holders of the proposed ordinance amendment, she would <br />ask the amount of cubic feet of display space they each have. <br />Christian Torkelson asked if the cubic foot calculation would include <br />product storage. The City Administrator suggested that storage of a box <br />of tobacco products under the counter, as an example, would not be <br />included in the calculation. Anything as part of the visible display area <br />would be counted. <br />It was the consensus of the Council to proceed with notification of the <br />General Tobacco Sales & Display License holders of Council <br />consideration of the ordinance amendment at its November 12th meeting. <br />CALL FOR The City Attorney recommended that a closed session be held to discuss <br />CLOSED pending litigation with St. Paul Regional Water Service (SPRWS) and a <br />SESSION — possible resolution to this litigation.
