MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 2014 <br />AMENDMENT The City Clerk noted that as was discussed at the September 10`x' meeting, <br />TO LIQUOR a member of the Planning Commission suggested that the City amend its <br />ORDINANCE Liquor Ordinance to decrease the number of On -Sale Restaurant Liquor <br />Licenses from two to one. The City current has one active On -Sale <br />Restaurant Liquor License. City staff has put together an ordinance <br />amendment which provides for the decrease as well as an automatic <br />annual adjustment of the initial investment necessary to qualify for an On - <br />Sale Restaurant Liquor License. The amendment also lists the numbers of <br />On -Sale Liquor Licenses and On -Sale Restaurant Liquor Licenses that are <br />available to the City under State Statute. The Clerk noted that if the <br />decrease is approved, the City will be at its maximum number of On -Sale <br />Licenses, but also listing the maximums provided for in State Statute will <br />put people on notice that there would the ability to request a City Code <br />change increasing the numbers. <br />The Clerk also reviewed some additional amendments proposed which <br />were more housekeeping in nature. Those include eliminating a reference <br />to the transfer of liquor licenses, since the Code does not allow for these <br />transfers, and eliminating the provision that an organization cannot have <br />more than one temporary liquor license within a 30 -day period. The Clerk <br />noted that there are limits on the number of temporary liquor licenses that <br />an organization can have within a year, and felt that additional 30 -day <br />restriction was unnecessary. <br />Montour asked about the State Statute which allows the City up to six On - <br />Sale Liquor Licenses, plus two additional as provided by Chapter 240, <br />1987 State Laws. Blesener indicated that at the time the City requested <br />two additional liquor licenses to hold an incentive to attract an upscale <br />restaurant or a hotel development. <br />The Council asked if the City Attorney had an opportunity to review the <br />proposed ordinance amendment. The Clerk indicated that approval could <br />be subject to any additional review that the City Attorney felt might be <br />warranted. The City Attorney stated that the ordinance amendment <br />appeared to be in order and recommended that any approval not be <br />contingent upon his review. Blesener sug,gested that consideration of the <br />ordinance be tabled until the October 12" meeting. Keis indicated his <br />support for the amendment as proposed. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-9-184 — ADOPTING ORDINANCE NO. 774, <br />AMENDING THE LITTLE CANADA CITY CODE, SECTION 703, <br />INTOXICATING LIQUOR, AS OUTLINED IN THE CITY CLERK'S <br />REPORT DATED SEPTEMBER 18, 2014 <br />5 <br />
