MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2014 <br />*APPROVAL OF FINAL PAYMENT TO REMACKEL FOR CITY <br />CENTER CONCRETE WORK; <br />*APPROVAL OFANAMENDMENT TO THE PERSONNEL POLICY <br />INCREASING TUITION REIMBURSEMENT AMOUNT AS <br />RECOMMENDED BY THE CITY ADMINISTRATOR <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />TOBACCO The City Clerk noted that the Council has been reviewing the City's <br />ORDINANCE tobacco ordinance over the past few months relative to the categories of <br />tobacco licenses. The Clerk noted that the tobacco ordinance provides for <br />two types of licenses, a General Tobacco Sales & Display License and a <br />Tobacco Store License. The General Tobacco License number is not <br />limited, but the Tobacco Store License is limited to two, both of which are <br />currently taken. <br />The Clerk pointed out that there are three issues before the Council this <br />evening. One relates to better defining the General Tobacco Sales & <br />Display License, one relates to the request of Kelly Ortiz for a tobacco <br />license that would all him to open a convenience store with 40% of the <br />floor area dedicated to tobacco sales, and the third relates to an inquiry by <br />an individual interested in growing and selling tobacco. <br />The Council discussed the inquiry about the ability for a resident to grow <br />and sell his own tobacco. The Clerk noted the City Attorney's <br />correspondence which states that the individual would likely need a <br />cigarette distributor license from the State of MN as well as points out that <br />fairly detailed records are then required for tax purposes. The City <br />Attorney indicated that if the City is interested in allowing this type of <br />business venture, his recommendation would be that the City license it. <br />The Clerk noted that the individual making the inquiry did not provide <br />many specifics, but indicated that he may be present at this evening's <br />meeting. It was the consensus of the Council to consider this matter at the <br />time that a specific proposal is put forth. <br />The Clerk then reviewed the proposed ordinance amendment which better <br />defines the City's General Tobacco Sales & Display License. She noted <br />that the proposed definitions clarify the way that the City has historically <br />handled these licenses. The ordinance states that tobacco sales under the <br />General Tobacco License must be accessory to the primary business <br />3 <br />
