MINUTES <br />CITY COUNCIL <br />NOVEMBER 12, 2014 <br />The Administrator noted that Mr. Fischer has a Conditional use Permit for <br />outdoor storage that relates to car dealers and car repair businesses that <br />were located inside the building. There are two businesses that have car <br />dealers licenses, and given the building is destroyed the zoning regulations <br />relative to these licenses cannot be met. Mr. Fischer has cancelled the <br />leases for these businesses given the need to rebuild. <br />The Administrator further reported that Mr. Fischer also had approval for <br />a small outdoor storage area that was not tied to a business located within <br />the building. Mr. Fisher would like to retain the ability to continue to <br />lease this small outdoor storage area. One additional issue is that Mr. <br />Fischer would like the ability to place a temporary storage container on his <br />proposed to store items related to his own business until the building can <br />be rebuilt. The Administrator pointed out that once a building permit is <br />issue to rebuild, a small storage container would be permitted. The City <br />Administrator reported that City staff is recommending that Mr. Fischer be <br />allowed to continue to lease the small outdoor storage area as well as be <br />allowed to place a temporary storage container on the property. <br />With regard to the auto sales licenses, the City Administrator indicated <br />that the license holders have requested that they be allowed to retain these <br />licenses. The Administrator reported that Mr. Fischer has evicted these <br />tenants from the property, but is hopeful that they will return once the <br />building is reconstructed. The Administrator indicated that he has <br />discussed the sales license issue with the City Planner and the City <br />Attorney, and it was their opinion that the City should not allow the <br />licenses to remain active as they do not meeting zoning requirements. The <br />Administrator noted that these license holders also have sales licenses <br />issued by the State through the end of the year. The State has specific site <br />requirements tied to the licenses that cannot be met given the building has <br />been destroyed. Therefore, it is staff's recommendation that the City <br />revoke the licenses and then notify the State of the revocations. The <br />Administrator pointed out that the license holders would receive a notice <br />of revocation and would have the ability to appeal the revocation within <br />10 days of receiving notice of revocation. <br />Keis asked if there was another location within Ryan Industrial Park that <br />these businesses could temporarily relocate to. The City Administrator <br />was not sure there were any other properties that had active Conditional <br />Use Permits that would allow for auto sales. The Administrator noted that <br />the formal CUP process would need to be followed for these businesses to <br />legally relocate. <br />Keis asked if the size of the building could be increased. The City <br />Administrator indicated that Mr. Fischer can rebuild, but cannot increase <br />8 <br />
