MINUTES <br />CITY COUNCIL <br />JANUARY 10, 2007 <br />The Administrator recommended that given Vadnais Heights' current <br />position, the City Attorney be authorized to proceed from a legal <br />standpoint to stop the clock from ticking. The Administrator indicated <br />that, in the meantime, Mayor Blesener and he would meet with the <br />Vadnais Heights' Mayor and City Administrator. <br />Keis asked if the Metropolitan Council held any responsibility in this <br />matter. The City Administrator indicated that they may, and the issue of <br />responsibility would be explored as part of any legal proceedings. The <br />Administrator noted that the Metropolitan Council relied on a 1972 letter <br />from the City of Vadnais Heights relative to this issue as well as the <br />Vadnais Heights' Comprehensive Plan update of 2000. The 19721etter <br />did not apply to this area according to the Vadnais Heights City <br />Administrator. The Administrator also noted that the Vadnais Heights' <br />City Attorney is relying on a 1954 Attorney General's opinion relative to <br />their position on the Statute of Limitations and any payment beyond <br />would be considered a gift. The City Administrator pointed out that an <br />Attorney General opinion is not law. <br />Montour asked what legal action would be necessary to stop the Statute of <br />Limitations clock from ticking. The City Administrator indicated that the <br />City may have to serve Vadnais Heights with a notice of claim against <br />them. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTIONNO.2007-I-7-AUTHORIZING THE CITY <br />ATTORNEY TO COMMENCE THE APPROPRIATE LEGAL <br />PROCEEDINGS AGAINST THE CITY OF VADNAIS HEIGHTS <br />RELATIVE TO SEWER BILLING ISSUE <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />OASIS The City Administrator presented a draft of the purchase agreement for <br />PURCHASE the Oasis property noting that the purchase price is $815,000 which is <br />AGREEMENT below the 2007 Ramsey County Estimated Market Value of $887,000. <br />The Administrator noted the property would be used in the re-alignment of <br />Viking Drive proposed as part of the 2007 Improvement Projects. <br />The Administrator noted that the purchase agreement holds Oasis <br />responsible Por tank removal and obtaining closure from the PCA. <br />Estimated cost of this work is $15,000 to $20,000. The Administrator also <br />noted that Oasis would like to close on the property by the end of the <br />
