MINUTES <br />CITY COUNCIL <br />DECEMBER 15, 2014 <br />APPEAL OF <br />LICENSE <br />REVOCATION - <br />PONY AUTO <br />SALES & <br />NOVA AUTO <br />for other staff members with just a few additional adjustments to bring <br />three positions in line with comparable positions in other cities as based on <br />League of MN Cities salary survey information. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2014-12-227 — RATIFYING 2015 SALARIES AS <br />PRESENTED BY THE CITY ADMINISTRATOR AND AS <br />DISCUSSED AT THE DECEMBER 15, 2014 COUNCIL WORKSHOP <br />MEETING AS PART OF THE CITY ADMINISTRATOR'S <br />PERFORMANCE REVIEW <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reviewed the Code Enforcement Officer's report <br />dated December 10, 2014 relative to the revocation of Indoor Retail Sales <br />Licenses at Nova Auto, 200 Ryan Drive, and Pony Auto Sales, 202 Ryan <br />Drive. The Administrator pointed out that the building from which these <br />two businesses operated was destroyed by fire last fall. The building <br />has been removed and the building owner has cancelled the leases with <br />Nova Auto and Pony Auto Sales. Given there is no building to operate <br />from, the City revoked the Indoor Retail Vehicle Sales Licenses for both <br />businesses. The business owners have looked for other locations within <br />Little Canada, but none have the proper zoning in place to accommodate <br />Indoor Retail Vehicle Sales. The Administrator noted that the Code <br />provides an appeal process relative to the revocation, and both businesses <br />have appealed the matter. The Administrator also cited the section of the <br />Zoning Code addressing Indoor Retail Vehicle Sales, and noted that there <br />are few if any properties in the City that would currently be able to comply <br />with the Code requirements. <br />The City Attorney clarified that the property owner has cancelled the <br />leases with Nova Auto and Pony Auto Sales. The City Administrator <br />reported that that is what the building owner has told the City. The City <br />Attorney noted that the City has provided proper notice of the revocation <br />as well as the ability to file an appeal to the two business owners. <br />Reabar Abdullah, Pony Auto Sales, reported that both his business and <br />Nova Auto are in the process of trying to liquidate their inventory. He <br />pointed out that this is a difficult process given the time of the year. <br />Abdullah indicated that he has moved some of his cars to Balta's Towing, <br />and they are in the process of repairing these vehicles.
