MINUTES CITY COUNCIL DECEMBER 15, 2014 APPEAL OF LICENSE REVOCATION - PONY AUTO SALES & NOVA AUTO for other staff members with just a few additional adjustments to bring three positions in line with comparable positions in other cities as based on League of MN Cities salary survey information. Keis introduced the following resolution and moved its adoption: RESOLUTION NO. 2014-12-227 — RATIFYING 2015 SALARIES AS PRESENTED BY THE CITY ADMINISTRATOR AND AS DISCUSSED AT THE DECEMBER 15, 2014 COUNCIL WORKSHOP MEETING AS PART OF THE CITY ADMINISTRATOR'S PERFORMANCE REVIEW The foregoing resolution was duly seconded by Boss. Ayes (4). Nays (0). Resolution declared adopted. The City Administrator reviewed the Code Enforcement Officer's report dated December 10, 2014 relative to the revocation of Indoor Retail Sales Licenses at Nova Auto, 200 Ryan Drive, and Pony Auto Sales, 202 Ryan Drive. The Administrator pointed out that the building from which these two businesses operated was destroyed by fire last fall. The building has been removed and the building owner has cancelled the leases with Nova Auto and Pony Auto Sales. Given there is no building to operate from, the City revoked the Indoor Retail Vehicle Sales Licenses for both businesses. The business owners have looked for other locations within Little Canada, but none have the proper zoning in place to accommodate Indoor Retail Vehicle Sales. The Administrator noted that the Code provides an appeal process relative to the revocation, and both businesses have appealed the matter. The Administrator also cited the section of the Zoning Code addressing Indoor Retail Vehicle Sales, and noted that there are few if any properties in the City that would currently be able to comply with the Code requirements. The City Attorney clarified that the property owner has cancelled the leases with Nova Auto and Pony Auto Sales. The City Administrator reported that that is what the building owner has told the City. The City Attorney noted that the City has provided proper notice of the revocation as well as the ability to file an appeal to the two business owners. Reabar Abdullah, Pony Auto Sales, reported that both his business and Nova Auto are in the process of trying to liquidate their inventory. He pointed out that this is a difficult process given the time of the year. Abdullah indicated that he has moved some of his cars to Balta's Towing, and they are in the process of repairing these vehicles. He has also 10
