MINUTES CITY COUNCIL DECEMBER 15, 2014 the proposed lease has been prepared by the City Attorney and is before the Council for action this evening. Key terms of the lease include an annual rent of $15,000 with the administrator noting that Verizon initially offered $9,000 and a consultant review has indicated that the $15,000 is at the high end of the range. The agreement also provides for a 3% per year escalator versus the 2% initially offered by Verizon. The Administrator noted that this cell tower will be located in the City's redevelopment area and rather than granting Verizon an access easement that may negatively impact future redevelopment, the City will guarantee Verizon access to the site. The City is also requiring a $10,000 performance bond to guarantee removal of the tower should they discontinue its use. The initial term of the lease is for five years, with the option for four, five-year extensions. The City Administrator noted that given 53 South Owasso Blvd. is owned by the City's Economic Development Authority (EDA), the Council should convene as the EDA in order to act on the proposed lease. Montour introduced the following resolution and moved its adoption: RESOLUTION NO. 2014-12-238 —AUTHORIZING THE ECONOMIC DEVELOPMENT AUTHORITY TO ACT ON THE VERIZON LEASE AGREEMENT FOR 53 SOUTH OWASSO BLVD. The foregoing resolution was duly seconded by Boss. Ayes (4). Nays (0). Resolution declared adopted. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO. 2014-12-239 — TEMPORARILY ADJOURNING AS THE CITY COUNCIL AND CONVENING AS THE ECONOMIC DEVELOPMENT AUTHORITY The foregoing resolution was duly seconded by Keis. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO. 2014-12-240 —APPROVING THE CELL TOWER LEASE AGREEMENT WITH VERIZON FOR PROPERTY LOCATED AT 53 SOUTH OWASSO BLVD. AND AUTHORIZING VICE 19
