MINUTES <br />PLANNING COMMISSION <br />FEBRUARY 12, 2015 <br />Keller Parkway and talk to her directly about the proposed property <br />division. <br />Duray asked the proposed pond size. The City Engineer estimated it to be <br />15 to 20 feet wide and about 130 feet long. <br />Pechmann indicated that there are a couple of trees that exist in the same <br />area proposed for the storm water pond. Pechmann asked if these trees <br />would be replace. The Planner again noted that the developer will be <br />required to comply with the City's Tree Replacement requirements. <br />Duray stated that he has concerns about run-off from 716 LaBore Road <br />onto the adjacent property, and noted that the City has not heard from the <br />owner of 715 Keller Parkway. Duray suggested that perhaps the matter <br />should be tabled by the Commission to give the property owner additional <br />time to comment. <br />The City Planner pointed out that the City is required to provide mailed <br />notice on matters such as this to all property owners within 350 feet. He <br />also noted that the City does not have a practice of contacting certain <br />property owners given it does not want to make a discretionary decision <br />about who to personally contact or not. The City Planner stated that he <br />would be reluctant to recommend tabling action on this matter based on an <br />adjacent property owner not providing comment. However, if there is an <br />issue that the Commission is uncomfortable with and would like additional <br />information, the Planner felt that was an adequate reason to table action. <br />Schwalbach asked the options that were available in the event the <br />developer talks to the owner of 715 Keller Parkway and she is not willing <br />to grant an easement to pipe runoff through her property. Duray asked if <br />increasing the size of the storm water pond was the only option. The City <br />Engineer indicated that there may be other options such as installing a <br />storm water pipe across 711 Keller Parkway rather than 715 Keller <br />Parkway. The Engineer suggested a conditional approval by the Planning <br />Commission and if a pipe across 715 Keller Parkway is not possible, staff <br />can come back with different solutions. <br />Schwalbach again pointed out that if the property was not being <br />subdivided, the matter of storm water drainage may not be before the <br />Planning Commission. Schwalbach felt that if the plan proposed does not <br />make the storm water issue any worse, then he did not see a reason to not <br />approve it. Schwalbach did feel, however, that the applicant should try to <br />work out a solution with the owner of 715 Keller Parkway. <br />-7- <br />
