MINUTES <br />CITY COUNCIL <br />MARCH 11, 2015 <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />NSCC The City Administrator reported that the North Suburban Cable <br />JOINT Commission (NSCC) has proposed changed to the Joint Powers <br />POWERS Agreement (JPA) that governs the Commission. Many of the changes <br />AGREEMENT are the result of meetings with Mayors and City Managers to deal with <br />concerns involving the franchise renewal process and an attempt to keep <br />Shoreview as a member of the Commission, while other changes are <br />housekeeping in nature. Shoreview did withdraw from the Commission at <br />the end of 2014. <br />The Administrator then recapped the JPA changes as are outlined in his <br />March 61h report. Other than the housekeeping changes, the changes <br />include clarification of voting, requiring that JPA changes are approved by <br />all members before enactment, and changing notification requirements for <br />a member wishing to withdraw from the Commission to allow more time <br />for planning for related budget/operation revisions. <br />The Administrator also reported that NSCC has changed its operating by- <br />laws with the primary change being the designation of a City Manager <br />committee to advise the Commission on operating issues. The purpose of <br />this committee is to provide greater information to each city at a staff level <br />relative to operational implications of NSCC decisions, including <br />franchise renewal issues. The Administrator noted potential future <br />impacts to PEG fees will have a significant impact to the NSCC. <br />McGraw asked where negotiations are with Century Link. Montour <br />reported that the public hearing is being held this Thursday with public <br />comments taken through Friday. At that point the Commission will go <br />into negotiations with Century Link. McGraw asked about Century Link's <br />build -out status. Montour reported that Comcast is required to provide <br />service to the entire 9 member cities, while Century Link is claiming that <br />they will not initially be required to provide service to all areas of the 9 <br />member cities. Montour felt that if the Century Link proposal to get into <br />the cable market proceeds, there will likely be litigation. Montour pointed <br />out that if the Century Link proposal moves forward, the 9 member cities <br />will be fortunate to have two cable providers. The City Administrator <br />pointed out that Century Link will indemnify the member cities from any <br />litigation. Montour also noted Little Canada should be in position to get <br />full cable service should Century Link be successful in moving forward as <br />a cable provider. <br />9 <br />
