MINUTES <br />CITY COUNCIL <br />APRIL 22, 2015 <br />REASSESSMENT <br />OF HIA FEES — <br />CANABURY <br />SQUARE <br />WHISPERING <br />PINES <br />DEVELOPMENT <br />AGREEMENT <br />of train noise. The City Planner reported that he informed the property <br />owner that this would require a significant variance given the maximum <br />fence height under the ordinance is 6 '/2 feet. The City Administrator <br />reported that the property in question is on Maple Lane and given the <br />topography of the area, the fence would have to be quite high to provide <br />any benefit. The Administrator also noted the Special Purpose Fence <br />provision in the ordinance may be an option. <br />The Council discussed this matter and felt requests of this nature should be <br />handled under the Special Purpose Fence provision so that the Council has <br />the ability to review each case on an individual basis. The City Planner <br />indicated that he would review this provision and it may be necessary to <br />make some modifications. <br />The City Clerk reported that there are four properties in the Canabury <br />Square Condominiums that have lost their qualifying state to defer their <br />Housing Improvement Area assessment. Two of these properties have <br />been foreclosed on and the other two are not rental properties. Therefore, <br />City staff is recommending that the deferred assessment balance be <br />recertified to property taxes for the remaining balance of the initial <br />assessment term, through the year 2024. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2015-4-72 —APPROVING THE <br />RECERTIFICATION OF HIA DEFERRED ASSESSMENTS AS <br />RECOMMENDED BY THE CITY CLERK IN HER APRIL 10, 2015 <br />REPORT <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that back in 2008 the City approved the <br />Final Plat for Whispering Pines and has extended that approval so that it is <br />still valid. The property owner is now selling to property to J. W. Moore, <br />Inc. who will be proceeding with the development. The Administrator <br />noted that the plat meets all of the City's zoning requirements. The <br />Administrator submitted a Development Agreement for the Whispering <br />Pines development with J. W. Moore, Inc. to the Council for approval, <br />noting that the agreement contains the standard terms that have been used <br />for other developments in the City. <br />16 <br />
