Commercial Recreation. Those establishments serving alcoholic beverages in <br />conjunction with pool hall, bingo, golf, indoor firearms/archery ranges, and amusement <br />centers as a principal use, provided that: <br />1. If located within a shopping center, the use has its own exclusive exterior <br />access. <br />2. Any and all applicable local, state and federal laws, permits licenses and <br />operational regulations are complied with. <br />3. The use is located and developed so as not to create an incompatible <br />operation problem with adjoining and neighboring commercial and/or <br />residential uses. <br />4. The hours of operation shall be subject to City Council control and change as <br />a means to maintain compatibility of uses and activities. <br />5. The provisions of Section 921.010.0 of this Ordinance are considered and <br />satisfactorily met. <br />As is evident from these provisions, the compatibility with the surrounding land uses is <br />the primary consideration for a CUP in a location such as Gordies. While there does <br />not appear to be significant concern with conflicts to the east, where commercial <br />property exists, there may be concerns related to the property's boundary with the <br />residential property to the west. The applicants should clarify how these concerns might <br />be addressed through operational considerations or other improvements. <br />Summary and Recommendation <br />Staff notes that there are potential concerns with the level of activity combined with <br />outdoor alcohol consumption. To address these concerns, staff would recommend that <br />any approval of the CUP include the following conditions: <br />1. Enclosure of the entire consumption area with a permanent chain Zink fence, or <br />utilization of other materials that will secure the area in compliance with state and <br />local liquor regulations. <br />2. More detailed lighting plan to ensure that lighting does not glare or interfere with <br />the residential use of the adjoining property. <br />3. Replacement of the corridor fencing (denoted as "A" on the site plan) with either <br />permanent fencing, or rigid temporary fencing that will secure the corridor <br />connection between the indoor and outdoor consumption areas on the site. <br />4. Consideration of limitations to days and hours as proposed by the applicant, or <br />as modified by the Commission and City Council. <br />5.
