The Planner Commission felt that the <br />applicant's proposal to have outdoor recreation Monday through Friday <br />until 10 p.m. and up to 6 weekend tournaments per year was acceptable. <br />The Planner noted that the primary point of discussion at the Planning <br />Commission related to the corridor fencing, with the applicant indicating <br />her need to be able to put up and take down this fencing before and after <br />each event. <br />McGraw asked the City Attorney if he had a conflict of interest in this <br />matter given he is a property owner adjacent to Gordies'. The City <br />Attorney reported that conflicts of interest are governed under State <br />Statute. He pointed out the Council's practice of acting with transparency, <br />and stated that from a position of openness and conservativeness, he <br />would determine that Council Member McGraw may have a non - <br />contractual conflict of interest in this situation. The City Planner cited <br />some case law relative to potential disqualifying factors, and advised <br />McGraw not to participate in the discussion on this matter. <br />Kim Cossack, General Manager of Gordies' Place, reported that the <br />Planning Commission asked how the poly fence would attach to the fence <br />poles. Cossack brought a fence pole showing how the poly would attach <br />to it. Cossack reported that the poly fencing would be used for walkway <br />from the back door of the bar to the recreation area and chain link would <br />be used to enclose the recreation area. The fencing would be 4 feet high. <br />Cossack reported that there would be staff members present to monitor the <br />recreation area. Cossack reported that her plan would be to have bean <br />bags three nights per week and horseshoes another. She indicated that at <br />this time she would not be scheduling anything for Friday evenings. <br />Cossack reported that they do not plan to have broom ball or boot hockey. <br />Keis stated that he was not sure that 4 foot high fencing would be <br />adequate. Cossack stated that she thought this was a State requirement, <br />but indicated that the height of the fencing could be adjusted. She also <br />reported that she and her staff have had liquor awareness training and <br />would be monitoring the situation. <br />Montour commented on the location of the poly fencing as well as the <br />proposed gates in this fencing. Cossack indicated that the gates would be <br />monitored by staff members. Montour asked if liquor would be sold in the <br />recreation area. Cossack reported that it would only be consumed in the <br />recreation area. Montour asked about people bringing their own liquor <br />into the recreation area.
