MINUTES <br />CITY COUNCIL <br />JULY 25, 2007 <br />Repair. The Planner indicated that it was not a permitted use in the I-1 <br />District, and was only allowed in the B-2 District given it is a more retail <br />oriented use. <br />Keis noted the requirement that major auto repair businesses would have <br />to store all vehicles waiting for repair indoors. The City Planner replied <br />that to have outdoor storage, the proposed ordinance would require that <br />the property owner obtain an Interim Use Permit. <br />The Planner next reviewed his proposed standards related to Interim Use <br />Permits. He noted that rather than requiring a CUP for outdoor storage, <br />the proposal is to require an IUP. The interim use could have several <br />triggers for expiration, such as a specific expiration date, sale of the <br />property, code enforcement issues, etc. The IUP would require a <br />development agreement between the City and the property owner within <br />which all the conditions would be spelled out. <br />Blesener stated that he liked the IUP options, noting that it would provide <br />for an expiration of the outdoor storage use. He noted the CUP that <br />McGough has for outdoor storage on their property which provides for no <br />established standards. <br />The Planner indicated that there are a couple of administrative downsides <br />to the IUP. The first is that the IUP would be tied to the property owner <br />and not the tenants. There will be some struggle to determine how much <br />outdoor storage individual tenants are entitled to. The Planner <br />recommended that the City license the individual outdoor storage users to <br />gain some control over the tenants. <br />Allan stated that her concern is when the outdoor storage use would <br />sunset. Would it be when the property is sold, at a specific date, or as the <br />result of code enforcement issues? Allan asked if the City would address <br />enforcement with property owners rather than tenants. The City Planner <br />indicated that ultimately the responsibility for the property lies with the <br />property owner. However, the business licensing aspect will provide the <br />City with some control over the tenant. The Planner suggested that it <br />would be better to tie license renewal to code enforcement activities than <br />tying the IUP to enforcement issues. <br />Blesener asked if other cities are utilizing IUP's for outdoor storage rather <br />than CUP's. The Planner indicated that he is aware of one other <br />community utilizing NP's, but noted that a number of communities are <br />having this discussion. The Planner further pointed out that many cities <br />are no longer allowing outdoor storage at all. <br />
